RESOLUTION NO. RS2016-376

A resolution amending Resolution No. R90-1136, pertaining to the creation and membership of the Community Corrections Advisory Board for Davidson County.

WHEREAS, under Resolution No. R90-1136, the Community Corrections Advisory Board for Davidson County was created to facilitate community and professional supervision of any alternative sentencing programs implemented in Davidson County; and,

WHEREAS, Section 2 of the Resolution established certain Community Corrections Advisory Board member positions, including a state probation officer nominated by the commissioner of the department of corrections, and a state parole officer nominated by the executive director of the board of paroles; and,

WHEREAS, Tenn. Code. Ann. § 40-36-201(a)(1)(F), the statute authorizing the creation of the Board and requiring these positions, states that two state probation and parole officers assigned to work in the county are to be nominated by the department of correction and confirmed by the county legislative body;

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: That the Council of the Metropolitan Government of Nashville and Davidson County does hereby amend Resolution No. R90-1136, by deleting Section 2(A)(6) and Section 2(A)(7) in their entirety, and replacing Section 2(A)(6) as follows:
“Two state probation and parole officers assigned to work in Davidson County, nominated by the department of correction and confirmed by the metropolitan council; and”

Section 2: That the Council of The Metropolitan Government of Nashville and Davidson County does hereby amend Resolution No. R90-1136, by re-numbering Section 2(A)(8) with the next appropriately numbered subsection.

Section 3: This resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring.
