ORDINANCE NO. BL2016-425

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 95 linear feet of 12 inch sewer main, approximately 12 linear feet of 18 inch sewer main, approximately 235 linear feet of 24 inch sewer main and to accept approximately 96 linear feet of 30 inch public sewer main, approximately 176 linear feet of 24 inch public sewer main, approximately 37 linear feet of 24 inch public sewer main, and any associated easements on property located at 901 Woodland Street (MWS Project No. 15-SL-189 and Proposal No. 2016M-040ES-001).

WHEREAS, the abandonment of approximately 95 linear feet of 12 inch sewer main, approximately 12 linear feet of 18 inch sewer main, approximately 235 linear feet of 24 inch sewer main and the acceptance of approximately 96 linear feet of 30 inch public sewer main, approximately 176 linear feet of 24 inch public sewer main, approximately 37 linear feet of 24 inch public sewer main, and any associated easements on property located at 901 Woodland, are needed to construct project No. 15-SL-189 and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2016M-04ES-001 on August 17, 2016, for the abandonment and acceptance of said sewer mains and any associated easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 95 linear feet of 12 inch sewer main, approximately 12 linear feet of 18 inch sewer main, approximately 235 linear feet of 24 inch sewer main and to accept approximately 96 linear feet of 30 inch public sewer main, approximately 176 linear feet of 24 inch public sewer main, approximately 37 linear feet of 24 inch public sewer main, and any associated easements on property located at 901 Woodland Street, as shown below and on Exhibit 1, which is attached hereto and incorporated by reference:

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
