ORDINANCE NO. BL2016-426

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon an existing water main and fire hydrant and to accept public sewer main, three man holes, water main and one fire hydrant assembly, and any associated easements, located at 601 11th Avenue North (MWS Projects No. 16-WL-008 and 16-SL-0013 and Proposal No. 2016M-036ES-001).

WHEREAS, the abandonment of 453 linear feet of six inch public water main and one fire hydrant assembly and the acceptance of approximately 337 linear feet of eight inch public sewer main, three manhole assemblies, approximately 453 linear feet of eight inch public water main, one fire hydrant assembly and any associated easements for property located at 601 11th Avenue North, are needed to construct MWS Projects No. 16-WL-008 and 16-SL-0013 and;

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2016M-036ES-001 on August 11, 2016, for the abandonment and acceptance of said sewer or water mains, fire hydrants and easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon 453 linear feet of six inch public water main and one fire hydrant assembly and to accept approximately 337 linear feet of eight inch public sewer main, three manhole assemblies, approximately 453 linear feet of eight inch public water main, one fire hydrant assembly and any associated easements, for property located at 601 11th Avenue North, as shown below and on Exhibit 1, which is attached hereto and incorporated by reference:

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
