Metropolitan Council Meeting

The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Reverend Henry Stover of Hicks Tabernacle Baptist Church.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The roll was called and the following members were present during the progress of the meeting: Barry, Steine, Tygard, Maynard, Matthews, Harrison, Hunt, Banks, Scott Davis, Westerholm, Anthony Davis, Bennett, Pridemore, Glover, Stites, Stanley, Claiborne, Tenpenny, Moore, Allen, Gilmore, Langster, Weiner, Evans, Holleman, McGuire, Harmon, Blalock, Dominy, Johnson, Potts, Bedne, Dowell, Duvall, Todd, Mitchell and Neighbors (37); Absent: Garrett, Pardue, Baker (3).

The Minutes of the regular meeting of May 6, 2014, were approved.

- ELECTIONS AND CONFIRMATIONS -

Metropolitan Auditor
The President called for the appointment of a Metropolitan Auditor. The Audit Committee unanimously recommended Mr. Mark Swann for the position. Second and third candidates, respectively, were Colonel J. Cline and Mr. Anthony Neumaier. The ballot was taken, with the following vote: Swann: Barry, Steine, Tygard, Maynard, Matthews, Harrison, Hunt, Banks, Scott Davis, Westerholm, Anthony Davis, Bennett, Pridemore, Glover, Stites, Stanley, Claiborne, Moore, Allen, Gilmore, Langster, Weiner, Evans, Holleman, McGuire, Harmon, Blalock, Dominy, Johnson, Potts, Bedne, Dowell, Duvall, Todd, Mitchell (35); Cline: Tenpenny (1); Neumaier (0). The President declared that Mr. Mark Swann was appointed to the position of Metropolitan Auditor.

Metropolitan Nashville Airport Authority
Reappointment of Mrs. Juli Mosley for a term expiring April 6, 2018. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Electric Power Board
Appointment of Mr. Robert Campbell, Jr. for a term expiring July 1, 2015. Mr. Campbell will fill the unexpired term of Ms.Yanika Smith-Bartley. The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Board of Parks and Recreation
Reappointment of Mr. George Anderson for a term expiring April 30, 2019. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Planning Commission
Appointment of Ms. Jessica Farr for a term expiring March 31, 2018. At the request of the appointee, the confirmation was deferred.

Transportation Licensing Commission
Reappointment of Mr. Sal Hernandez for a term expiring April 30, 2016. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Mr. Ben Jordan for a term expiring April 30, 2016. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

- RESOLUTION ON PUBLIC HEARING -

RESOLUTION NO. RS2014-1090

A resolution exempting Pop, LLC located at 604 Gallatin Road from the minimum distance requirements for obtaining a beer permit pursuant to Section 7.08.090.E. of the Metropolitan Code. The resolution was approved by the Public Safety-Beer and Regulated Beverages Committee. Mr. Scott Davis requested a hearing from the public on this resolution which had been previously advertised. The President asked if anyone desired to be heard for or against the resolution and no one came forward to be heard. The President declared the public hearing closed. - CONSENT AGENDA RESOLUTIONS -

RESOLUTION NO. RS2014-1091

A resolution appropriating a total of $2,000,000 from the Barnes Fund for Affordable Housing to various nonprofit organizations selected to receive grant funds to assist in providing good quality affordable housing to residents of Davidson County with limited means. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2014-1092

A resolution approving an application for a Community Corrections Services Grant from the State of Tennessee, Department of Correction, to The Metropolitan Government of Nashville and Davidson County, acting by and through the State Trial Courts, to divert felony offenders from the Tennessee prison system by providing community supervision and treatment services. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2014-1093

A resolution approving Amendment One to a grant from the State of Tennessee, Department of Transportation, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Police Department, for enhanced DUI enforcement patrols to reduce the number of traffic crashes and fatalities that occur as a result of impaired driving. The resolution was approved by the Budget and Finance and Public Safety-Beer and Regulated Beverages Committees.

RESOLUTION NO. RS2014-1094

A resolution approving an intergovernmental agreement by and between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Police Department (hereinafter “MNPD”), and the U.S. Army Corps of Engineers for extra-duty police services. The resolution was approved by the Budget and Finance and Public Safety-Beer and Regulated Beverages Committees.

RESOLUTION NO. RS2014-1095

A resolution accepting a grant from the State of Tennessee, Department of Health, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, for Help Us Grow Successfully (HUGS) services to provide home visits and assessments to Davidson County residents. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2014-1096

A resolution accepting a grant from the State of Tennessee, Department of Health, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to provide public health activities to enhance the health and well-being of women, infants, and families by improving community resources and planning public health services.
The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2014-1097

A resolution accepting a grant from the State of Tennessee, Department of Health, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to provide food safety services to Davidson County residents and to conduct surveys as required. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2014-1102

A resolution accepting a grant from the Metropolitan Development and Housing Agency to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Historical Commission, to perform Section 106 environmental review necessary for development proposals using federal funds to determine potentially adverse effects to historic properties. The resolution was approved by the Budget and Finance and Planning, Zoning and Historical Committees.

RESOLUTION NO. RS2014-1103

A resolution authorizing the Metropolitan Department of Law to compromise and settle the personal injury claims of Chasidy Buchanon against the Metropolitan Government of Nashville and Davidson County in the amount of $9,000.00, and that said amount be paid out of the Self-Insured Liability Fund. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2014-1104

A resolution approving the election of certain Notaries Public for Davidson County. The resolution was approved by the Rules-Confirmations-Public Elections Committee.

RESOLUTION NO. RS2014-1082

A resolution requesting the Metropolitan Development and Housing Agency to create a redevelopment plan for a portion of Council District 5 and requesting the Industrial Development Board to explore the creation of an economic impact plan for the same area. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2014-1105

A resolution recognizing May 2014 as American Stroke Month. The resolution was approved by the Rules-Confirmations-Public Elections Committee.

RESOLUTION NO. RS2014-1106

A resolution proclaiming the week of May 18-24, 2014, as Public Works Week in Davidson County. The resolution was approved by the Rules-Confirmations-Public Elections Committee.

RESOLUTION NO. RS2014-1088

A resolution providing amendments to the Charter of The Metropolitan Government of Nashville and Davidson County, Tennessee, in accordance with Article 19, Section 19.01, and setting forth a brief description of each amendment to be placed on the ballot.

The resolutions were referred to the Charter Revision Commission; the Charter Revision Committee made the following recommendations: Amendment No. 1, Disapproved; Amendment No. 2, withdrawn at request of councilmember; Amendment No. 3, Disapproved; Amendment No. 4, Approved; Amendment No. 5, Approved; Amendment No. 6, Approved.

Ms. Allen moved to defer the resolutions and re-refer them to the Charter Revision Committee, which motion was seconded and adopted by a voice vote of the Council.

A resolution approving a contract by and between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, and McNeilly Child Care Center to perform activities related to the Project Diabetes Golden Sneaker Initiative Program. BILL NO. BL2014-775

An ordinance establishing the tax levy in the general services district for the fiscal year 2014-2015, and declaring the amount required for the annual operating budget of the urban services district, pursuant to section 6.07 of the Metropolitan Charter. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance Committee by a voice vote of the Council.

BILL NO. BL2014-777

An ordinance amending Section 2.144 of the Metropolitan Code regarding the continuation of the Metropolitan Homelessness Commission and establishment of its duties and responsibilities. BILL NO. BL2014-778

An ordinance amending Chapter 10.60 of the Metropolitan Code to transfer the administration and personnel regarding the registration of burglar and fire alarms systems and the Board of Alarm Appeals from the Metropolitan Clerk’s Office to the Department of Codes Administration. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Codes, Fair and Farmers Market Committees by a voice vote of the Council.

An ordinance amending Chapter 7.08 of the Metropolitan Code to amend the definition of “performing arts facility” to include certain facilities identified under T.C.A. § 57-4-102 as an Urban Park Center. Upon motion duly seconded, the bill passed first reading and was referred to the Public Safety-Beer and Regulated Beverages Committees by a voice vote of the Council.

BILL NO. BL2014-783

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to acquire all or a portion of the property located at 864 Idlewild Drive for the construction of the Clean Water Nashville Overflow Abatement program project (Gibson Creek Equalization Facility), (Project No. 11-SC-0139; OAP.C.33.01 and Proposal No. 2014M-007PR-001). The bill was approved by the Planning Commission. BILL NO. BL2014-784

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to negotiate and accept permanent and temporary easements for the I-40/I-440 South Sewer Relocation Project for five properties located at 442 37th Avenue North, 37th Avenue North (unnumbered), and 435, 509, and 516 36th Avenue North, (Project No. 13-SG-0129 and Proposal No. 2014M-010ES-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance, Public Works and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2014-785

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to acquire property through negotiations, condemnation, or fee simple take, for one property located at Cabot Drive (unnumbered) for the construction of Davidson Branch Equalization Facility zoned SP-MU, (Project No. 11-SC-111 and Proposal No. 2014M-012PR-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance, Public Works and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2014-786

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon retained easement rights in a portion of the former right-of-way of 53rd Avenue North (closed via Council ordinance O75-1262) for the property located at 5300 Kentucky Avenue, (Proposal No. 2014M-020ES-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Public Works and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2014-787

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending the Harpeth Village Commercial Planned Unit Development Overlay District on property located at 8002 Highway 100, approximately 280 feet west of Temple Road, zoned CL (1.12 acres), to permit the construction of a 7,000 square foot automobile service facility where a 3,150 square foot automobile convenience facility with 6 fuel islands and an automatic car wash was previously approved, all of which is described herein (Proposal No. 2005P-008-005).
The bill was approved by the Planning Commission with conditions, disapproved without. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning and Historical Committee by a voice vote of the Council.

Without objection, the rules were suspended for consideration of one (1) late bill.

BILL NO. BL2014-788

An ordinance adopting the Capital Improvements Budget and Program 2014-2015 through 2019-2020 for The Metropolitan Government of Nashville and Davidson County as the official Capital Improvements Budget and Program of The Metropolitan Government of Nashville and Davidson County for Fiscal Year 2014-2015. Mr. Steine moved to pass the bill on first reading and was referred to the Budget and Finance and Planning, Zoning and Historical Committees by a voice vote of the Council.

- BILLS ON SECOND READING -

BILL NO. BL2014-665

An ordinance amending Ordinance No. O65-464, as amended by Ordinances Nos. O68-525 and 080-294, relating to the levy of a local option sales and use tax by the Metropolitan Government to increase the amount of the tax for the purpose of funding mass transit and providing additional funding for Metropolitan Nashville Public Schools. The Budget and Finance Committee recommended deferral. Mr. Tygard moved to defer the bill, which motion was seconded. After discussion, the matter recurred on the motion to defer, which motion failed by a roll call vote. Mr. Tygard moved to withdraw the bill, which motion was seconded and adopted by a voice vote of the Council.

SUBSTITUTE BILL NO. BL2014-666

An ordinance amending Chapter 5.32 of the Metropolitan Code to increase the amount of the annual vehicle regulatory license fee to provide a local dedicated funding source for mass transit for the purpose of regulating traffic control. The Budget and Finance and Traffic, Parking and Transportation Committees recommended deferral. Mr. Tygard moved to withdraw the bill, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-698

An ordinance amending Section 11.32.010 of the Metropolitan Code pertaining to the enforcement mechanism associated with the discontinuance of the delivery of nonsubscription published material. The Codes, Fair and Farmers Market Committee recommended deferral. Mr. Claiborne moved to defer the bill, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-748

An ordinance approving an agreement by and between The Metropolitan Government of Nashville and Davidson County, by and through the Metropolitan Nashville Arts Commission, and the WESTAF for archiving public art (Public Art Archive), and authorizing the execution of the same. The bill was approved by the Budget and Finance Committee. Mr. Steine moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-749

An ordinance to amend the Geographic Information Systems Street and Alley Centerline Layer for the Metropolitan Government of Nashville and Davidson County by abandoning portions of right-of-way and easements for Alley No. 442 along the eastern property line of Tax Map Parcel No. 10408025000 (Proposal No. 2014M-003AB-001). The bill was approved by the Planning Commission, Traffic and Parking Commission, Public Works and Planning, Zoning and Historical Committees. Ms. Moore moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-750

An ordinance to amend the Geographic Information Systems Street and Alley Centerline Layer for the Metropolitan Government of Nashville and Davidson County by abandoning right-of-way and easements for Jackson Court and Alley No. 204 (Proposal No. 2014M-004AB-001). The bill was approved by the Planning Commission, Traffic and Parking Commission, Public Works and Planning, Zoning and Historical Committees by a voice vote of the Council. Ms. Gilmore moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

An ordinance declaring surplus and approving the disposition of certain parcels of real property labeled Exhibits A-N and described below ( Proposal No. 2014M-013PR-001). The bill was approved by the Planning Commission, Budget and Finance, and Planning, Zoning and Historical Committees by a voice vote of the Council. Mr. Steine moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-752

An ordinance declaring surplus and approving the disposition of a certain parcel of real property labeled Exhibit A and described below ( Proposal No. 2014M-015PR-001). The bill was approved by the Planning Commission, Budget and Finance and Planning, Zoning and Historical Committees. Ms. Gilmore moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-753

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 420 linear feet of eight inch water main, approximately 395 linear feet of 10 inch sewer main, and approximately 330 linear feet of eight inch sewer main for properties located at 419 Jefferson Street, 1023 4th Avenue North, 0 Fifth Avenue North, and 1007 4th Avenue North, (MWS Project Nos. 14-WL-11 and 14-SL-12 and Proposal No. 2014M-016ES-001). The bill was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committees. Ms. Gilmore moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-754

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 130 linear feet of an existing eight inch sewer main and to construct approximately 15 linear feet of eight inch D.I.P water main and one fire hydrant assembly and approximately 108 linear feet of eight inch PVC sewer main for properties located at 336 and 345 Hill Avenue, (MWS Project Nos. 14-WL-4 and 12-SL-86 and Proposal No. 2014M-014ES-001).
