Metropolitan Council Meeting

The Metropolitan Council met in regular session on this date at 7:00 p.m. in the Metropolitan Courthouse.

The invocation was offered by Councilman Charlie Tygard.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

- COMMITTEE REPORTS ON MATTERS OTHER THAN LEGISLATION -

The Rules-Confirmations-Public Elections Committee recommended indefinite deferment of the following proposed amendment to the Rules of Procedure of the Metropolitan Council:

Rule No. 8.
Amending by adding the following new paragraph:

The Metropolitan Clerk shall not permit any Member of Council to sign a resolution or ordinance that has
been previously filed without the written consent of the primary sponsor.

Mr. Wallace moved to defer the proposed amendment indefinitely, which motion was seconded and adopted by a voice vote of the Council.

- ELECTIONS AND CONFIRMATIONS -

Solid Waste Region Board
Reappointment of Mr. Daniel Lane for a term expiring December 15, 2012. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Transportation Licensing Commission
Reappointment of Ms. Holly Sharp for a term expiring October 10, 2008. Without objection, the nomination was withdrawn.

RESOLUTION NO. RS2006-1675

A resolution appropriating $5,000 from the Reserve Council Infrastructure Program, Nonprofit Grants and Council Initiatives Account of the General Fund of the General Services District to Nashville Inner City Ministry, Inc. to provide partial funding for its program services. The resolution was approved by the Budget and Finance Committee. RESOLUTION NO. RS2007-1709

A resolution accepting a grant from the Robert Wood Johnson Foundation to The Metropolitan Government of Nashville and Davidson County, by and through the Board of Health, for the development of information systems to enhance the emergency preparedness of public health services. RESOLUTION NO. RS2007-1710

A resolution approving a contract for services by and between the Metropolitan Government and Douglas Cornish, DMD, to provide dental services to patients of the Downtown Clinic. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees with an amendment. Mr. Ryman offered Amendment No.1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. An ordinance amending Title 2 of the Metropolitan Code of Laws authorizing the creation of a Downtown Central Business Improvement District and appointing a corporation to act as an advisory board to the district with the necessary powers and authority to carry out the purposes and intent of the district. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance Committee by a voice vote of the Council.

BILL NO. BL2007-1313

An ordinance abandoning a 10" sanitary sewer line and easement that will be replaced by an 8" sanitary sewer line, that is shown on Map 104-10, Parcel 108.00, Project 06-SL-0063, The Chesterfield, 511 Chesterfield Avenue, and authorizing the execution of the documents to carry out the abandonment (Proposal No. 2006M-158U-10).The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Public Works and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2007-1314

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from OR20 and R6 to MUG zoning, property located at Hume Street (unnumbered) and 8th Avenue North (unnumbered) (1.52 acres total), all of which is described herein (Proposal No. 2006Z-008U-08). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning and Historical Committee by a voice vote of the Council.

BILL NO. BL2007-1315

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R8 to RM6 zoning, property located at Bell Road (unnumbered), at the northeast corner of Bell Road and Lincoya Bay Drive (17.89 acres total), all of which is described herein (Proposal No. 2006Z-188U-14). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning and Historical Committee by a voice vote of the Council.

BILL NO. BL2005-651

An ordinance amending Section 12.08.150 of the Metropolitan Code by reducing the authority to tow vehicles illegally parked within the area of Metropolitan Government. The Public Safety-Beer and Regulated Beverages Committee recommended deferment. Mr. Wallace moved to defer the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2006-998

An ordinance amending Chapter 13.08 and Chapter 13.16 of the Metropolitan Code of Laws to prohibit any temporary or permanent encroachment into the public right-of-way without first obtaining a permit from the Metropolitan Government. The bill was approved by the Public Works Committee. Mr. Wallace moved to defer the bill on second reading for final figures from the Department of Public Works, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2006-1065

An ordinance amending Section 13.32.120 of the Metropolitan Code of Laws to prohibit chain link fences along arterial and collector streets. The Public Works Committee recommended deferment. Mr. Wallace moved to defer the bill on second reading to the second meeting in February and requested referral to the Codes, Fair and Farmers Market Committee, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2006-1262

An ordinance amending Section 16.12.130 of the Metropolitan Code of Laws to allow the installation of plumbing fixtures designed to reduce or eliminate water consumption. The Codes, Fair and Farmers Market and Public Works Committees recommended deferment. Mr. Jameson moved to defer the bill to the second meeting in February, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2006-1277

An ordinance authorizing the Metropolitan Government to participate with Wood Ridge Development LLC, to provide public sewer service in Davidson County to Carothers Crossing UDO, Project No. 06-SL-0048. The bill was approved by the Budget and Finance and Public Works Committees. Mr. Toler moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2006-1304

An ordinance to amend the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County, by changing the name of a portion of Gateway Boulevard between Davidson Street and 4th Avenue South to "Korean War Veterans Memorial Boulevard" (Proposal No. 2006M-231U-09). The bill was approved by the Planning, Zoning and Historical Committee; the Public Works and Traffic and Parking Committees recommended deferment. Mr. Ryman moved to defer the bill to the second meeting in March so that Public Works can respond to questions on the matter, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2006-1305

An ordinance authorizing the Metropolitan Government to participate with Cates-Kottas Development to provide public sewer service in Williamson County to Brookfield Subdivision, Section 14, Project No. 04-SL-190. The bill was approved by the Budget and Finance and Public Works Committees. Mr. Brown moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2006-1306

An ordinance authorizing the Director of Public Property to exercise an option to purchase real property (Map 85, Parcels 17 and 18 - 1015 and 1014 Stones River Road) to be used by Parks and Recreation as part of the Stones River greenway system and as a Nature Center, and to grant a conservation easement to The Land Trust for Tennessee, Inc. (Proposal No. 2006M-224G-14). The bill was approved by the Budget and Finance; Parks, Library, Recreation and Public Entertainment Facility; and Planning, Zoning and Historical Committees with an amendment. Mr. White offered Amendment No.1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. Mr. White moved to pass the bill on second reading as amended, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2007-1307

An ordinance amending Section 6.80.550 of the Metropolitan Code to eliminate the $200.00 storage fee for items stored at the Police Department Impound Lot, except for those items that are seized by the Police Department as a result of suspected criminal activity. The Budge and Finance and Public Safety-Beer and Regulated Beverages Committees recommended deferment. Mr. Wallace moved to defer the bill on second reading while the Police Department provides additional information, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2007-1308

An ordinance amending Chapter 12.52 of the Metropolitan Code to make persons operating motorized wheelchairs or similar vehicles or devices subject to the same regulations and privileges provided to pedestrians. The bill was approved by the Public Safety-Beer and Regulated Beverages Committee. Mr. Forkum moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2007-1309

An ordinance amending Chapter 13.08 of the Metropolitan Code pertaining to the naming of public rights-of-way in honor of persons who are deceased. The bill was approved by the Public Works and Planning, Zoning and Historical Committees. Mr. Wallace moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2007-1310

An ordinance authorizing a property tax exemption for nonprofit community and performing arts organizations in accordance with Tennessee Code Annotated § 67-5-223. The bill was approved by the Budget and Finance Committee. Mr. Jameson moved to defer the bill on second reading so that revenue implications can be determined, which motion was seconded and adopted by a voice vote of the Council.

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS5 to MUL district properties located at 103 and 105 West Trinity Lane, approximately 120 feet west of Dickerson Pike (.48 acres), all of which is described herein (Proposal No. 2006Z-046U-05). SUBSTITUTE BILL NO. BL2006-1107

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from OR20 to SP district zoning on property located at 2002 Richard Jones Road to allow an existing three-story office building, with ground floor commercial uses including, but not limited to, retail and restaurant uses, approximately 575 feet east of Hillsboro Pike (3.93 acres), all of which is described herein (Proposal No. 2006Z-090U-10). The bill was approved by the Planning Commission; the Planning, Zoning and Historical Committee approved the bill with an amendment. Mr. Shulman offered Amendment No.1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2006-1108

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by canceling a Planned Unit Development located at 2002 Richard Jones, all of which is more particularly described herein (Proposal No. 138-82-U-10). The bill was approved by the Planning Commission and Planning, Zoning and Historical Committee.

A resolution requesting the Metropolitan Civil Service Commission to recommend an amendment to the longevity pay plan for Metropolitan Government employees to remove the requirement that part-time employees work 2,080 hours to be entitled to a year's accumulated service. The Budget and Finance and Personnel-Public Information-Human Relations-Housing Committees recommended deferment. Mr. Walls moved to defer the resolution to the first meeting in April, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2007-1727

A resolution requesting the Metropolitan Board of Parks and Recreation, the Tennessee Department of Environment and Conservation, the Harpeth River Watershed Association, The Land Trust for Tennessee, Inc., and the Tennessee Scenic Rivers Association to consider accepting a donation of the old Hutton Stone Quarry property located at 7448 McCrory Lane for purposes of land preservation. Mr. Tygard offered a substitute resolution and moved that it be accepted for filing and no objection was made.

BILL NO. BL2006-1297

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing a portion of the property from AR2a to SP zoning located at 7848 McCrory Lane, adjacent to the CSX Railroad and south of Highway 70 (30 acres) to permit 180 townhomes, all of which is described herein (Proposal No. 2006SP-174G-06). Mr. Tygard moved to re-refer the bill to the Planning Commission, which motion was seconded and adopted by a voice vote of the Council.
