ORDINANCE NO. BL2006-1283

An Ordinance amending Chapters 17.04, 17.08, 17.12, 17.16 and 17.20 of Title 17 of the Metropolitan Code, Zoning Regulations, to modify the definition of "mobile vendor", to designate mobile vendor as a use permitted with conditions, and to add certain conditions applicable to mobile vendors, all of which is more specifically described herein (Proposal No. 2006Z-190T).

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Chapter 17.04 of Title 17 of the Code of The Metropolitan Government of Nashville and Davidson County, Zoning Regulations, is hereby amended by amending Section 17.04.060 by deleting the definition of "mobile vendor" in its entirety and substituting in lieu thereof the following new definition:

"Mobile vendor" means a person who peddles, vends, sells, displays, or offers for sale goods, wares or merchandise at a temporary location and/or on a temporary or occasional basis. Notwithstanding the foregoing, vendors selling only food and/or beverages and street vendors licensed pursuant to 13.08.040 of the metropolitan code of laws shall not be considered "mobile vendors."

Section 2. That Chapter 17.08 of Title 17 of the Code of The Metropolitan Government of Nashville and Davidson County, Zoning Regulations, is hereby amended by amending Section 17.08.030, District Land Use Tables, by adding "mobile vendor" as a use permitted with conditions (PC) in the CF, CL, CS and CA districts.

Section 3. That Chapter 17.12 of Title 17 of the Code of The Metropolitan Government of Nashville and Davidson County, Zoning Regulations, is hereby amended by amending Section 17.12.040 by deleting subsection F in its entirety.

Section 4. That Chapter 17.16 of Title 17 of the Code of The Metropolitan Government of Nashville and Davidson County, Zoning Regulations, is hereby amended by amending Section 17.16.070 by inserting the following as subsection "L" under "Commercial Uses" and relettering the remaining subsections accordingly:

"L. Mobile Vendor. This use shall be allowed only within a permanent, enclosed structure."

Section 5. That Chapter 17.20 of Title 17 of the Code of The Metropolitan Government of Nashville and Davidson County, Zoning Regulations, is hereby amended by deleting Section 17.20.135 in its entirety.

Section 6. That this Ordinance shall take effect five (5) days from and after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Amendment No. 1
To
Ordinance No. BL2006-1283

Mr. President:

I move to amend Ordinance No. BL2006-1283 as follows:

1. By amending Section 1 by deleting the definition of "mobile vendor" and substituting in lieu thereof the following new definition:

"Mobile vendor" means a person who peddles, vends, sells, displays, or offers for sale goods, wares or merchandise at a temporary location and/or on a temporary or occasional basis. Notwithstanding the foregoing, vendors selling only food and/or beverages, vendors selling living plants and agricultural products, and street vendors licensed pursuant to 13.08.040 of the metropolitan code of laws shall not be considered "mobile vendors".

2. By amending Section 4 by deleting the provisions of the new subsection L. and adding the following new provisions:
"L. Mobile Vendor. This use shall be allowed according to the following standards:
1. This use shall be allowed only within a permanent, enclosed structure.
2. No tables, crates, cartons, racks or other devices shall be used outdoors to increase the selling or display capacity of the mobile vendor outside the permanently, enclosed structure."
