ORDINANCE NO. BL2006-1236

An ordinance amending Section 6.80.330(A) of the Metropolitan Code of Laws.

WHEREAS, Section 6.80.330(A) of the Metropolitan Code of Laws permits the Metropolitan Transportation Licensing Commission to conduct criminal background checks of applicants for wrecker driver permits; and,

WHEREAS, the Transportation Licensing Commission currently conducts such background checks only to determine Davidson County criminal history; and,

WHEREAS, concern for public safety dictates that the Metropolitan Transportation Licensing Commission should conduct a more thorough background check for wrecker driver permit applicants; and,

WHEREAS, the cost of conducting a more thorough background investigation would exceed the current amount of ten dollars that is assessed to each applicant.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Section 6.80.330(A) of the Metropolitan Code of Laws shall be amended by replacing the phrase "plus an additional ten dollars for an investigation" with the phrase "plus the cost of investigation."

Section 2. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Ordinance No. BL2006-1236

Mr. President:

I move to amend Ordinance No. BL2006-1236 by deleting Section 1 in its entirety and substituting in lieu thereof the following new Section 1:

"Section 1. That Section 6.80.330 of the Metropolitan Code of Laws shall be amended by deleting subsection A. in its entirety and substituting in lieu thereof the following new subsection A.:

"A. A driver's permit issued by the commission to a driver or driver's helper permitting such person to drive, ride in or assist in the operation of a wrecker shall be issued for a period of two years at a fee of twenty dollars, plus an additional forty dollars for an investigation of the person applying for the permit. The commission shall have the authority to adopt future increases in the fee to pay for the cost of the investigation of the permit applicant, subject to approval of the metropolitan council by resolution."
