ORDINANCE NO. BL2006-1277

An ordinance authorizing the Metropolitan Government to participate with Wood Ridge Development LLC, to provide public sewer service in Davidson County to Carothers Crossing UDO, Project No. 06-SL-0048.

WHEREAS, , Wood Ridge Development LLC, has expressed a desire to provide public sewer service in Davidson County, Tennessee, to a development known as Carothers Crossing UDO; and

WHEREAS, The Metropolitan Government of Nashville and Davidson County, Department of Water and Sewerage Services, will purchase transport capacity in the City of LaVergne's sewers to move the sewage flow from Davidson County into Rutherford County and back into Davidson Count; and

WHEREAS, it is deemed to benefit both parties and the general community, Carothers Crossing UDO, Wood Ridge Development LLC, agrees to fund the City of LaVergne's cost of constructing capacity in the City of LaVergne's sewer system to serve the Carothers Crossing UDO ; and

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. The Director of Water and Sewer Services is hereby authorized to execute a participation agreement, Exhibit 1, with Wood Ridge Development LLC, to provide public sewer services in Davidson County, Tennessee, to Carothers Crossing UDO Development, Project No. 06-SL-0048.

SECTION 2. That the monies collected to fund the estimated $1,425,000.00 will be deposited as a contribution-in-aid of construction in Water and Sewer Extension and Replacement Fund No. 47335.

SECTION 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
