ORDINANCE NO. BL2006-1306

An ordinance authorizing the Director of Public Property to exercise an option to purchase real property (Map 85, Parcels 17 and 18 - 1015 and 1014 Stones River Road) to be used by Parks and Recreation as part of the Stones River greenway system and as a Nature Center, and to grant a conservation easement to The Land Trust for Tennessee, Inc. (Proposal No. 2006M-224G-14).

WHEREAS, expansion of the Metropolitan park and greenway system enhances recreational opportunities for Davidson County residents and visitors; and,

WHEREAS, pursuant to the terms of the agreement attached as Exhibit A and incorporated into this ordinance by reference, the Metropolitan Government holds an option to purchase a parcel of property (Parcels 17 and 18 on Map 85 of the Metropolitan Government's official records; the "Property") located along the States River and ideally suited for use in expanding the park and greenway system; and,

WHEREAS, the Property has great historical significance; and,

WHEREAS, the Metropolitan Board of Parks and Recreation has approved the purchase of the Property; and,

WHEREAS, the Metropolitan Government's option to purchase the Property is subject to a requirement that a conservation easement covering the Property be granted to the Land Trust of Tennessee, Inc. ("Land Trust"); and,

WHEREAS, pursuant to the terms of the document attached as Exhibit B and incorporated into this ordinance by reference, the Metropolitan Government proposes to grant a conservation easement to enable the Land Trust to oversee the preservation of the historical context of the site; preservation for outdoors recreation and education of the general public; preservation of natural habitat for wildlife and plants; and preservation of open space for scenic enjoyment of the general public; and,

WHEREAS, it is in the best interest of the citizens of the Metropolitan Government to approve the purchase of said property and grant the conservation easement.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

SECTION 1. The Director of Public Property Administration is hereby authorized to exercise the option to purchase the property (Map 85, Parcels 17 and 18 - 1015 and 1014 Stones River Road respectively) as shown in Exhibit A and to execute the necessary documents pertaining thereto.

SECTION 2. The Director of Public Property Administration is hereby authorized to grant a conservation easement to The Land Trust of Tennessee, Inc. as shown in Exhibit B and to execute the necessary documents pertaining thereto.

SECTION 3. This resolution shall take effect upon passage, the welfare of The Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.

1. By amending the second recital clause to change "States River" to "Stones River."
2. By substituting original Exhibit A for the attached new Exhibit A.
3. By substituting original Exhibit B for the attached new Exhibit B.
