Metropolitan Council Meeting
Thursday, July 6, 2006


The Metropolitan Council met in adjourned session on this date at 6:00 p.m. in Metro City Hall.

The invocation was offered by Councilmember Harold White.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The roll was called and the following members were present during the progress of the meeting: Dozier, Neighbors, Tucker, Briley, Isabel, Craddock, Murray, Jameson, Cole, Hart, Forkum, Ryman, Brown, Gotto, Burch, White, Loring, McClendon, Greer, Hausser, Wallace, Walls, Whitmore, Summers, Shulman, Adkins, Foster, Alexander, Wilhoite, Toler, Coleman, Tygard and President Gentry (33); Absent: Dread, Gilmore, Crafton, and Williams (4).

The Minutes of the adjourned meeting of June 27, 2006, were approved.

The President announced that the first regular meeting of the Metropolitan Council in September 2006 has been re-scheduled for Tuesday, August 29, 2006, at 6:00 p.m. in Metro City Hall to accommodate move preparations for the return to the Metropolitan Courthouse.

- COMMITTEE REPORTS ON MATTERS OTHER THAN LEGISLATION -

The Rules-Confirmation-Public Elections Committee recommended approval of the following proposed amendment to Rule No. 25 of the Rules of Procedure of the Metropolitan Council

By deleting the last three sentences of the rule and substituting in lieu thereof the following new sentences:

"Announcements, extraordinary matters, and the presentation of memorializing and congratulatory resolutions
shall be held forty-five (45) minutes prior to all regularly scheduled Council meetings. The president pro
tempore or his/her designee shall preside over such matters. No presentation of memorializing or congratula-
tory resolutions shall be conducted during a regularly scheduled meeting of the Council."

Mr. Gotto moved to adopt the proposed amendment, which motion was seconded. Mr. Isabel moved to table the motion, which motion was seconded and failed by a voice vote of the Council. The matter recurred on the motion to adopt, which motion failed by the following vote: "Ayes" Dozier, Neighbors, Craddock, Jameson, Forkum, Ryman, Brown, Gotto, White, Wallace, Walls, Shulman, Adkins, Foster, Toler, Coleman, Tygard (17); "Noes" Tucker, Briley, Isabel, Cole, Burch, McClendon, Greer, Wilhoite (8); "Abstaining" Whitmore (1).

The Rules-Confirmation-Public Elections Committee recommended approval of the following proposed amendment to Rule No. 22 of the Rules of Procedure of the Metropolitan Council

By adding the following new paragraph:

"All resolutions accepting donations on behalf of departments, boards, and commissions of the Metropolitan
Government shall be automatically deferred one meeting upon being introduced."

Mr. Wallace moved to defer the proposed amendment, which motion was seconded and adopted by a voice vote of the Council.

- ELECTIONS AND CONFIRMATIONS -

Airport Authority
Reappointment of Mr. Frank M. Garrison for a term expiring June 4, 2010. Without objection the nomination was withdrawn and re-submitted for consideration at the next meeting.

Reappointment of Ms. Juli H. Mosley for a term expiring April 6, 2010. Without objection the nomination was withdrawn and re-submitted for consideration at the next meeting.

Board of Equalization
Appointment of Ms. Connie Hardin for a term expiring April 1, 2008, as a General Services District representative. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Fair Board
Appointment of Mr. James M. Weaver for a term expiring April 6, 20119. Without objection, the nomination was deferred.

Human Relations Commission
Appointment of Mr. Carter Andrews for a term expiring April 18, 2007. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Public Library Board
Appointment of Ms. Alice Randall for a term expiring April 6, 2013. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Sports Authority
Appointment of Mr. Rusty Lawrence for a term expiring December 19, 2011. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Ms. Helen Walker for a term expiring February 19, 2008. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Stormwater Management Committee
Appointment of Ms. Emily Carr for a term expiring July 8, 2009. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Adkins moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Zoning Appeals Board
Appointment of Mr. Albert Cocke for a term expiring February 26, 2011. Without objection the nomination was withdrawn.

Without objection Bill Nos. BL2003-84 and BL2006-1035 were considered together.

BILL NO. BL2003-84

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a district to RM9 district property located at 91 Tusculum Road along the south margin of Tusculum Road at Benzing Road, (4.45 acres), all of which is more particularly described herein (Proposal No. 2003Z-080U-12). The bill was approved by the Planning Commission.

BILL NO. BL2006-1035

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by making applicable the provisions of a Planned Unit Development district located at 91 Tusculum Road, to allow 40 townhomes (4.45 acres), all of which is described herein (Proposal No. 2006P-004U-12). The bill was approved by the Planning Commission.

Mr. Coleman requested a hearing from the public on these bills which had been previously advertised. The President asked if anyone desired to be heard for or against the bills and no one came forward to be heard. The President declared the public hearing closed. Mr. Coleman moved to pass the bills on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2006-1029

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R6 to CL district property located at 4416 Bass Avenue, approximately 300 feet west of Nolensville Pike (0.12 acres), all of which is described herein (Proposal No. 2006Z-024U-12). The bill was approved by the Planning Commission. Mr. Foster moved to defer the bill indefinitely, the bill being requested by Dana A. Moore, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2006-1031

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R20 to RM4 (36.25 acres) district property located at Hicks Road (unnumbered), approximately 300 feet north of Stirrup Drive, all of which is described herein (Proposal No. 2006Z-023G-06). The bill was approved by the Planning Commission. Mr. Tygard, on behalf of the sponsor, requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in favor of and in opposition to passage of the bill. The President declared the public hearing closed. Mr. Tygard moved to defer the bill on second reading, the bill being requested by Chris Fort, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2006-1036

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from OR20 to MUG zoning properties at 2100 and 2104 Clifton Avenue, at the northwest corner of Clifton Avenue and 21st Avenue North (.63 acres), all of which is described herein (Proposal No. 2006Z-051U-08). The bill was approved by the Planning Commission. Mr. Whitmore moved to defer the bill to the August public hearing due to insufficient notice, the bill being requested by CJF 8th Avenue Property, LLC, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2006-1038

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R6 to RM15 district properties located at 811, 813, and 815 Sylvan Street between South 8th and South 9th Streets (.61 acres), all of which is described herein (Proposal No. 2006Z-040U-05). The bill was approved by the Planning Commission. Mr. Jameson requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and a citizen was heard in favor of the bill. The President declared the public hearing closed. A letter was filed for the record in this matter. Mr. Jameson moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2006-1042

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R6 to SP zoning, properties located at 1818 and 1900 Eastland Avenue and Eastland Avenue (unnumbered), between 18th and 20th Streets, to permit the development 99 residential units, 18,600 square feet of retail uses, 18,500 square feet of restaurant uses, 20,500 square feet of office uses, 6,800 square feet of personal care service uses, 3,000 square feet of custom assembly uses, and 3 single-family lots (7.26 acres), all of which is described herein (Proposal No. 2005SP-170U-05). The bill was approved by the Planning Commission. Mr. Jameson requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in favor of and in opposition to passage of the bill. The President declared the public hearing closed. Mr. Jameson offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. Mr. Jameson moved to pass the bill on second reading as amended and defer the bill to the first meeting in August, the bill being requested by March Egerton, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2006-1044

An ordinance amending Chapters 17.04 and 17.08 of Title 17 of the Metropolitan Code, Zoning Regulations, to add the use "After hours establishment" as a use permitted in the CL, CS, CF, CC, IWD, IR and IG districts, all of which is more specifically described herein (Proposal No. 2006Z-064T). The bill was approved by the Planning Commission. Mr. Briley requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. Briley offered a substitute bill and moved that it be accepted for filing, which motion was seconded and adopted without objection.

SUBSTITUTE BILL NO BL2006-1044

An Ordinance amending Chapters 17.04 and 17.08 of Title 17 of the Metropolitan Code, Zoning Regulations, to add the use "After hours establishment" as a use permitted in the CC and CF districts, all of which is more specifically described herein (Proposal No. 2006Z-064T). Mr. Briley moved to pass the bill on second reading and defer the bill indefinitely, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2006-1051

An ordinance amending Section 17.40.120 of Title 17 of the Metropolitan Code, Zoning Regulations, to require Council approval of modifications to planned unit developments that increase the number of residential dwelling units, all of which is more specifically described herein (Proposal No. 2006Z-080T). The bill was disapproved by the Planning Commission. Mr. Foster requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in opposition to passage of the bill. The President declared the public hearing closed. Mr. Foster moved to defer the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2006-1081

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R20 to RS20 zoning various properties located on Milesdale Drive and Milesdale Court, west of Lealand Lane (10.3 acres), all of which is described herein (Proposal No. 2006Z-060U-10). BILL NO. BL2006-1082

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending a Planned Unit Development district located at 3400 and 3410 Gallatin Pike to permit the addition of 0.37 acres and a new fuel center with 5 pumps and service kiosk (5.74 acres total), all of which is more particularly described herein (Proposal No. 64-85-P-05). BILL NO. BL2006-1104

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R40 to RS20 zoning on a portion of the property at 1811 Woodmont Boulevard (0.46 acres), and from R40 to RS40 on property at Woodmont Boulevard (unnumbered) and a portion of property at 1811 Woodmont Boulevard (1.17 acres), near the southwest corner of Woodmont Boulevard and Stokesmont Road, all of which is described herein (Proposal No. 2006Z-052U-10). BILL NO. BL2006-1106

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RM9 to OR40 district property located at Cheron Road (unnumbered), approximately 575 feet west of Briarville Road (5.33 acres), all of which is described herein (Proposal No. 2006Z-037G-04). The bill was approved by the Planning Commission. Mr. Dozier requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. Dozier moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council with Mr. Craddock "abstaining".

BILL NO. BL2006-1107

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from OR20 to MUL zoning property located at 2002 Richard Jones Road, approximately 575 feet east of Hillsboro Pike (3.93 acres), all of which is described herein (Proposal No. 2006Z-090U-10). The bill was disapproved by the Planning Commission.

BILL NO. BL2006-1108

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by canceling a Planned Unit Development located at 2002 Richard Jones, all of which is more particularly described herein (Proposal No. 138-82-U-10). The bill was disapproved by the Planning Commission.

Mr. Shulman moved to defer the bills to the August public hearing due to insufficient notice, the bills being requested by David P. Crabtree - Water's Edge Limited Partnership, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2006-1109

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS10 to SP zoning on property located at Nolensville Pike (unnumbered) to permit 25 townhomes, approximately 1,035 feet north of Hills Chapel Road (3.37 acres), all of which is described herein (Proposal No. 2006SP-061G-12). The bill was approved by the Planning Commission. Mr. Toler requested a hearing from the public on this bill which had been previously advertised. SUBSTITUTE BILL NO. BL2006-1110

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS7.5, R15 and R20 to SP district, properties along the south side of Kirtland Avenue, and both sides of Farrar Avenue, Hood Avenue, and Castleman Drive between Hillsboro Pike and Lone Oak Road (51.66 acres), to prohibit new duplexes and permit property owners with 45,000 square feet lots or parcels at the time of adoption of the SP to subdivide into up to three lots each, and apply basic development standards, all of which is described herein (Proposal No. 2005SP-119U-10). The bill was approved by the Planning Commission. Mr. Shulman requested a hearing from the public on this bill which had been previously advertised. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS10 to RM20 (.59 acres) and CS (4.0 acres) zoning property located at 115 Hart Lane, approximately 705 feet east of Dickerson Pike (4.59 acres total), all of which is described herein (Proposal No. 2006Z-057U-05). The bill was disapproved by the Planning Commission. Mr. Hart requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. Hart moved to pass the bill on second reading and defer the bill indefinitely until all matters are in order, the bill being requested by James M. Ballentine, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2006-1115

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a to RM4 zoning property located at 7874 McCrory Lane, approximately 1,850 feet south of Highway 70 (36.2 acres), all of which is described herein (Proposal No. 2006Z-067G-06). The bill was approved by the Planning Commission. Mr. Tygard moved to defer the bill to the August public hearing due to insufficient notice, the bill being requested by John G. Jones, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2006-1116

An ordinance amending Title 17 of the Metropolitan Code, Zoning Regulations, by amending Section 17.32.050 to prohibit certain temporary signs on Metropolitan Government property, all of which is more particularly described herein (Proposal No. 2006Z-127T). Mr. Tygard moved to defer the bill to the August public hearing so that the Planning Commission can make a recommendation on the proposal, which motion was seconded and adopted by a voice vote of the Council.

Without objection Bill Nos. BL2006-1117 and BL2006-1118 were considered together.

BILL NO. BL2006-1117

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R15 to SP zoning property located at Hamilton Church Road (unnumbered), approximately 900 feet east of Mt. View Road (9.0 acres), all of which is described herein (Proposal No. 2006SP-070G-13). The bill was approved by the Planning Commission.

BILL NO. BL2006-1118

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R15 to SP zoning property located at 3485 Hamilton Church Road, approximately 1,400 feet west of Hobson Pike (11.93 acres), all of which is described herein (Proposal No. 2006SP-077G-13). The bill was approved by the Planning Commission.

Mr. Briley requested a hearing from the public on these bills which had been previously advertised. The President asked if anyone desired to be heard for or against the bills and citizens were heard in favor of and in opposition to passage of the bills. The President declared the public hearing closed. Mr. Briley moved to pass the bills on second reading and defer the bills to the second meeting in August, the bills being requested by MEC Inc., which motion was seconded and adopted by a voice vote of the Council.
