The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Councilman Rosenberg.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

Electrical Examiners & Appeals Board
Appointment of Mr. Terry Atwood for a term expiring June 20, 2021. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Fire & Building Codes Appeals Board
Appointment of Mr. Rich McCoy for a term expiring June 20, 2021. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Gas/Mechanical Examiners Appeals Board
Appointment of Mr. Fil Harris, Jr. for a term expiring June 20, 2021. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Historic Zoning Commission
Appointment of Ms. Elizabeth Smith for a term expiring June 1, 2022. At the request of the appointee, the nomination was withdrawn.

Reappointment of Ms. Kaitlyn Jones for a term expiring June 1, 2022. The Rules, Confirmations, and Public Elections Committee recommended the reappointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Mr. J. Cyril Stewart for a term expiring June 1, 2022. The Rules, Confirmations, and Public Elections Committee recommended the reappointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Nashville Education Community & Arts TV (NECAT)
Appointment of Mr. Joe Woolley for a term expiring February 5, 2018. Mr. Wooley will fill the unexpired term of Mr. Joey Leslie. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Metropolitan Transit Authority
Reappointment of Ms. Gail Carr-Williams for a term expiring May 1, 2022. The Rules, Confirmations, and Public Elections Committee recommended the reappointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Without objection, BL2017-722 and BL2017-723 were taken out of order.

BILL NO. BL2017-722

A bill to be entitled: The Budget Ordinance of the Metropolitan Government of Nashville and Davidson County, Tennessee for Fiscal Year 2018. Mr. Cooper offered a substitute ordinance and moved that it be accepted for filing, which motion was seconded and adopted by a voice vote of the Council.

SUBSTITUTE BILL NO. BL2017-722

A bill to be entitled: The Budget Ordinance of the Metropolitan Government of Nashville and Davidson County, Tennessee for Fiscal Year 2018. The bill was approved by the Budget and Finance Committee. Mr. Cooper requested a suspension of the rules to allow Amendment No. 12 to be heard and no objection was made. Mr. Cooper offered Amendment No. 12 and moved for its adoption, which motion was seconded. After discussion, the matter recurred on the motion to adopt and was adopted by a roll call vote. A resolution accepting a grant from the State of Tennessee, Administrative Office of the Courts, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Davidson County Juvenile Court, for the provision of interpreter/translation services for individuals with limited English proficiency. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2017-748

A resolution accepting a grant from the State of Tennessee, Administrative Office of the Courts, to The Metropolitan Government of Nashville and Davidson County for the provision of interpretation/translation services for court hearings involving individuals with limited English proficiency in the Davidson County trial courts. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2017-749

A resolution accepting a grant from the State of Tennessee, Tennessee Arts Commission, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Arts Commission, for funding to non-profit organizations to conduct community arts projects in Davidson County. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2017-750

A resolution approving an application for a Community Corrections Services Grant from the State of Tennessee, Department of Correction, to The Metropolitan Government of Nashville and Davidson County, acting by and through the State Trial Courts, to divert felony offenders from the Tennessee prison system by providing community supervision and treatment services. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2017-751

A resolution approving a second amendment to a contract between the State of Tennessee, Department of Mental Health and Substance Abuse Services, and The Metropolitan Government of Nashville and Davidson County for establishing agreed rates for court ordered evaluations and treatment for defendants charged with misdemeanor crimes. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2017-752

A resolution approving an application for a Fire Prevention and Safety Grant from the United States Department of Homeland Security to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Fire Department, to implement a department wide training program designated to increase the investigative capacity needed to determine the act of arson or an arson related crime. The resolution was approved by the Budget and Finance and Public Safety, Beer, and Regulated Beverages Committees.

RESOLUTION NO. RS2017-753

A resolution approving an application for a Nashville Bike Grant from the Tennessee Highway Safety Office, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Police Department, to conduct vehicle and bicycle stops for the purpose of educating the public and gaining compliance with state and local ordinances. The resolution was approved by the Budget and Finance and Public Safety, Beer, and Regulated Beverages Committees.

RESOLUTION NO. RS2017-754

A resolution approving Amendment Two to a Letter of Agreement for Tobacco Settlement funding from the State of Tennessee, Department of Health, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to fund various programs addressing family tobacco use. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2017-755

A resolution accepting a grant from the Greater Nashville Regional Council to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Social Services Commission, to provide delivered meals that meet RDA nutritional guidelines to eligible seniors, and to provide transportation to elderly persons who are unable to drive or have no other transportation available. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2017-756

A resolution accepting a grant from the Greater Nashville Regional Council to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Social Services Commission, to provide Nutrition HCBS (Home and Community Based Services) to eligible seniors throughout Davidson County. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2017-757

A resolution accepting a grant from the State of Tennessee, Tennessee State Library and Archives, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Public Library, to provide access and circulation of special materials formatted for individuals who are hearing impaired. The resolution was approved by the Budget and Finance and Parks, Library, and Recreation Committees.

RESOLUTION NO. RS2017-758

A resolution accepting a grant from the State of Tennessee, Department of Environment and Conservation, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Public Works Department, to assist in the annual operation, maintenance, and facility improvements of a household hazardous waste collection facility. The resolution was approved by the Budget and Finance and Public Works Committees.

RESOLUTION NO. RS2017-760

RESOLUTION NO. RS2017-765

A resolution requesting that the Metro Nashville Network, in conjunction with the Department of Public Works, prepare and broadcast public service announcements promoting pedestrian awareness and safety. The resolution was approved by the Public Works Committee.

RESOLUTION NO. RS2017-766

A resolution requesting that the Nashville Fire Department Fire Marshal’s Office conduct an assessment of its special event permit fees to determine whether current fee amounts cover actual costs associated with issuance of said permits. The resolution was approved by the Codes, Fair, and Farmers Market and Public Safety, Beer, and Regulated Beverages Committees.

RESOLUTION NO. RS2017-764

A resolution to authorize the creation of an Adventure Tourism District and the submission of an application for certification of an Adventure Tourism District pursuant to the Tennessee Adventure Tourism and Rural Development Act of 2011. The Convention, Tourism and Public Entertainment Facilities Committee recommended deferment. Ms. Haywood moved to defer the resolution indefinitely, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2017-788

An ordinance amending section 2.177.080 of the Metropolitan Code of Laws setting the rate of levy of the special assessment for the Downtown Central Business Improvement District for Metropolitan Nashville and Davidson County, Tennessee. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance Committee by a voice vote of the Council.

BILL NO. BL2017-789

An ordinance amending Chapter 2.20 of the Metropolitan Code pertaining to the Office of Administrative Hearing Officer in accordance with Title 6, Chapter 54, Part 10 of the Tennessee Code Annotated. Upon motion duly seconded, the bill passed first reading and was referred to the Codes, Fair, and Farmers Market Committee by a voice vote of the Council.

BILL NO. BL2017-790

An ordinance amending Section 3.24.010 of the Metropolitan Code of Laws pertaining to health insurance benefits for Members of the Metropolitan Council after they leave office. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Personnel, Public Information, Human Relations, and Housing Committees by a voice vote of the Council.

BILL NO. BL2017-791

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to negotiate and accept permanent and temporary easements for the Bordeaux Hills Stormwater Improvement Project for seven properties located at 3300 Cocoa Drive, 1468 and 1495 County Hospital Road, and 3189, 3191, 3195 and 3197 Lagrange Drive (Project No. 17-SWC-249 and Proposal No. 2017M-040ES-002). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning, and Historical and Public Works Committees by a voice vote of the Council.

BILL NO. BL2017-792

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing sanitary sewer main and easements and to accept new water mains, fire hydrants, sanitary sewer mains, sanitary sewer manholes and any associated easements, for property located at 670 James Avenue (MWS Project No. 15-SL-299 and 15-WL-192 and Proposal No. 2017M-045ES-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning, and Historical and Public Works Committees by a voice vote of the Council.

BILL NO. BL2017-793

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing water main and easements and to accept new water main, a fire hydrant and any associated easements, for property located at 463 Harding Industrial Drive (MWS Project No. 17-WL-68 and Proposal No. 2017M-043ES-001). The bill was approved by the Planning Commission.
