ORDINANCE NO. BL2017-791

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to negotiate and accept permanent and temporary easements for the Bordeaux Hills Stormwater Improvement Project for seven properties located at 3300 Cocoa Drive, 1468 and 1495 County Hospital Road, and 3189, 3191, 3195 and 3197 Lagrange Drive (Project No. 17-SWC-249 and Proposal No. 2017M-040ES-002).

WHEREAS, the negotiation and acceptance of permanent and temporary easements for seven properties located at 3300 Cocoa Drive, 1468 and 1495 County Hospital Road, and 3189, 3191, 3195 and 3197 Lagrange Drive are needed to construct MWS Project 17-SWC-249; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2017M-040ES-002 on May 17, 2017, for the negotiation and acceptance of permanent and temporary easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to negotiate and accept permanent and temporary easements for seven properties located at 3300 Cocoa Drive, 1468 and 1495 County Hospital Road, and 3189, 3191, 3195 and 3197 Lagrange Drive as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the negotiations and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
