RESOLUTION NO. RS2017-764

A resolution to authorize the creation of an Adventure Tourism District and the submission of an application for certification of an Adventure Tourism District pursuant to the Tennessee Adventure Tourism and Rural Development Act of 2011.

WHEREAS, the Tennessee Adventure Tourism and Rural Development Act of 2011 (Tennessee Code Annotated §11-11-201, et seq.) creates a mechanism by which local communities can apply to be certified as an Adventure Tourism District; and

WHEREAS, local governing bodies must authorize the creation of an Adventure Tourism District by two-thirds (2/3) vote and such authorization must be submitted as part of the application to the Tennessee Department of Tourist Development and to the Tennessee Department of Revenue for joint approval of the Adventure Tourism District; and

WHEREAS, the application must also include a parcel map showing the boundaries of the proposed district and an Adventure Tourism District plan (which shall be more specifically defined in the application); and

WHEREAS, after approval, the local governing body may submit the Adventure Tourism District plan to the Tennessee Department of Revenue and the Tennessee Department of Tourist Development for approval of tax credits pursuant to Tennessee Code Annotated § 67-4-2109 and for promotional support; and

WHEREAS, an application is being submitted to the Tennessee Department of Economic and Community Development and to the Tennessee Department of Revenue for approval of an Adventure Tourism District to be located upon parcels along the east side of Whites Creek Pike, north of Green Lane to the southeast corner of the Whites Creek Pike & Knight Drive intersection, specifically including 4225 Whites Creek Pike, 4125 Whites Creek Pike, 4241 Whites Creek Pike, and 4105 Whites Creek Pike; and

WHEREAS, it is in the best interests of Nashville and Davidson County to support local tourism-related businesses and to encourage the creation of jobs in these communities through the creation of an Adventure Tourism District at this location.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Council, pursuant to the requirements of the Tennessee Adventure Tourism and Rural Development Act of 2011, hereby authorizes the creation of an Adventure Tourism District, with the boundaries of said district being set forth in the application, parcel map and plan attached hereto as Collective Exhibit A.

Section 2. The Metropolitan Council, pursuant to the requirements of the Tennessee Adventure Tourism and Rural Development Act of 2011, further authorizes the submission of the application, parcel map and plan attached hereto as Collective Exhibit A, to the Tennessee Department of Tourist Development and the Tennessee Department of Revenue for joint approval of the Adventure Tourism District. The mayor of the Metropolitan Government of Nashville and Davidson County, the director of finance, and other officers of the Metropolitan Government, are each hereby authorized, empowered and directed to do all such acts and things and to execute all such additional documents as may be necessary to carry out and comply with the provisions of the application as executed.

Section 3. The Metropolitan Clerk is directed to prepare a copy of this Resolution to be presented to the Tennessee Department of Tourist Development and the Tennessee Department of Revenue, together with a copy of the application, parcel map and plan attached hereto as Collective Exhibit A.

Section 4. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
