Metropolitan Council Meeting

The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Jennifer Knapp.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

Metropolitan Nashville Airport Authority
Reappointment of Dr. A. Dexter Samuels for a term expiring April 5, 2020. The Rules, Confirmations, and Public Elections Committee recommended the reappointment. Ms. Haywood moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Ms. Debbie Wright for a term expiring April 5, 2020. The Rules, Confirmations, and Public Elections Committee recommended the reappointment. Ms. Haywood moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Board of Fair Commissioners
Appointment of Ms. Bonna Johnson for a term expiring April 6, 2021. Ms. Haywood moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Electrical Examiners and Appeals Boar
Reappointment of Mr. R. Michael Williams for a term expiring February 15, 2020. The Rules, Confirmations, and Public Elections Committee recommended the reappointment. Ms. Haywood moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Public Library Board
Reappointment of Mr. Robert Oermann for a term expiring April 6, 2023. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Ms. Haywood moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Social Services Commission
Appointment of Mr. Michael Bradley for a term expiring April 3, 2021. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Ms. Haywood moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Ms. Charlene Peacock for a term expiring July 20, 2019. Ms. Peacock will fill the unexpired term of Ms. Kim Johnson. Ms. Haywood moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Mr. Steven Turner for a term expiring April 3, 2020. Mr. Turner will fill the unexpired term of Ms. Mary Rolando. Ms. Haywood moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Tourism and Convention Commission
Appointment of Ms. Tonya Lewis for a term expiring June 30, 2017. Ms. Haywood moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Traffic and Parking Commission
Appointment of Ms. Nora Kern for a term expiring April 3, 2021. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Ms. Kern will fill the unexpired term of Mr. Steven Turner. Ms. Haywood moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

- RESOLUTIONS ON PUBLIC HEARING –

RESOLUTION NO. RS2016-195

A resolution exempting 5th and Taylor, LLC, located at 1411 Fifth Avenue North, Nashville, TN 37208 from the minimum distance requirements for obtaining a beer permit pursuant to Section 7.08.090.E. of the Metropolitan Code. Mr. O’Connell requested a hearing from the public on this resolution which had been previously advertised. The President asked if anyone desired to be heard for or against the resolution and no one came forward to be heard. The President declared the public hearing closed. The resolution was approved by the Public Safety, Beer, and Regulated Beverages Committee. - CONSENT AGENDA RESOLUTIONS -

RESOLUTION NO. RS2016-196

A resolution accepting a grant from the State of Tennessee, Tennessee Arts Commission, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Arts Commission, for funding to non-profit organizations to conduct community arts projects in Davidson County. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2016-197

A resolution approving an application for an Emergency Solutions Grant from the Tennessee Housing Development Agency to The Metropolitan Government of Nashville and Davidson County, acting by and through the Social Services Commission in conjunction with the Homelessness Commission, to provide targeted outreach and support to individuals living in encampments and connecting them with opportunities and resources to move into permanent housing. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2016-199

A resolution authorizing the Director of Public Property to exercise an option to purchase a parcel of real property (Parcel ID 03800012600) for use as a public park by The Metropolitan Government of Nashville and Davidson County (Proposal No. 2016M-011PR-001). The resolution was approved by the Planning Commission, Budget and Finance, Parks, Library, and Recreation, and Planning, Zoning, and Historical Committees.

RESOLUTION NO. RS2016-200

A resolution amending Ordinance No. BL2014-783 by authorizing acquisition of two additional parcels for the construction of the Gibson Creek Equalization Facility as part of the Clean Water Nashville Overflow Abatement Program (Proposal No. 2016M-014PR-001). The resolution was approved by the Planning Commission, Budget and Finance, Planning, Zoning, and Historical, and Public Works Committees.

RESOLUTION NO. RS2016-201

A resolution approving cooperative agreement No.16ESTN000000028 with the United States Department of the Interior - United States Geological Survey for the continued operation and upgrades of Water Quality Monitors and flood warning gages in FY2017, FY2018, FY2019, FY2020, and FY2021 on Mill Creek, Dry Creek, Browns Creek, Richland Creek, Whites Creek, Stones River and Cumberland River. The resolution was approved by the Budget and Finance and Public Works Committees.

RESOLUTION NO. RS2016-202

A resolution classifying public roads in Davidson County, Tennessee. The resolution was approved by the Public Works Committee.

RESOLUTION NO. RS2016-204

A resolution authorizing 506 Church Lofts to construct and install an aerial encroachment at 506 Church Street for (Proposal No.2016M-011EN-001). The resolution was approved by the Planning Commission, Planning, Zoning, and Historical, and Public Works Committees.

RESOLUTION NO. RS2016-206

A resolution expressing the Metropolitan Council’s opposition to the National Pollutant Discharge Elimination System (NPDES) Permit for a limestone quarry and processing facility, asphalt plant and construction sand and gravel mine at 771 Burnett Road, Old Hickory, Tennessee 37138 sought by Industrial Land Developers, LLC (NPDES permit no. TN0069922). The resolution was approved by the Rules, Confirmations, and Public Elections Committee.

RESOLUTION NO. RS2016-207

A resolution recognizing and honoring The Harpeth Hall School on its Sesquicentennial. The resolution was approved by the Rules, Confirmations, and Public Elections Committee.

A resolution appropriating to certain accounts for the benefit of the Metropolitan Nashville Police Department, State Trial Courts, Davidson County Election Commission, District Attorney, Public Defender, Municipal Auditorium, Board of Fair Commissioners, Nashville Farmers’ Market, Department of General Services, and Administrative Department Three Million Thirty Three Thousand Three Hundred Dollars ($3,033,300). The resolution was approved by the Budget and Finance Committee. Mr. Pridemore requested a suspension of the rules to allow the resolution to be amended and no objection was made. Mr. Pridemore offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. A resolution approving a letter of agreement between the Metropolitan Government of Nashville and Davidson County and WGU Tennessee to assist with employee development goals by offering tuition discount to Metropolitan Government employees. RESOLUTION NO. RS2016-203

A resolution approving the post-construction stormwater control measures provided for in the Stormwater Management Manual, promulgated pursuant to Metropolitan Code of Laws Section 15.64.020, for purposes of compliance with SB1830/HB1892, pending before the State of Tennessee General Assembly, in anticipation that said bill will pass. The Public Works Committee recommended deferment. Mr. Elrod moved to defer the resolution to the second meeting in May, which motion was seconded and approved by a voice vote of the Council.

RESOLUTION NO. RS2016-205

A resolution authorizing the Metropolitan Department of Law to compromise and settle the two distinct wage and hour class action claims brought by Vonda Noel on behalf of herself and all other similarly situated Davidson County Sheriff's Office employees against the Metropolitan Government in the amount of $199,936.25 for the Fair Labor Standards Act class; and in the amount of $1,900,000.00 for the Rule 23 unpaid wages class; for a total of $2,099,936.25 to be paid out of the Judgment and Losses Fund.
The resolution was approved by the Budget and Finance Committee. Mr. Pridemore moved to adopt the resolution, which motion was seconded. Mr. Pulley moved to defer the resolution, which motion was seconded. After discussion Ms. VanReece called for the previous question, which motion was seconded and adopted by a voice vote of the Council. The matter recurred on the motion to defer and failed by a roll call vote. An ordinance amending Chapter 10.18 of the Metropolitan Code to prohibit smoking on the grounds of outdoor amphitheaters with a seating capacity of at least six thousand (6,000) owned or operated by the Metropolitan Government of Nashville & Davidson County. Upon motion duly seconded, the bill passed first reading and was referred to the Health, Hospitals, and Social Services Committee by a voice vote of the Council.

BILL NO. BL2016-206

An ordinance to amend Chapter 13.20 of the Metropolitan Code of Laws to authorize by permits private snow plow services. Upon motion duly seconded, the bill passed first reading and was referred to the Codes, Fair, and Farmers Market Committee by a voice vote of the Council.

BILL NO. BL2016-207

An ordinance readopting the Code of The Metropolitan Government of Nashville and Davidson County, Tennessee, prepared by Municipal Code Corporation including supplemental and replacement pages thereof, containing certain ordinances of a general and permanent nature enacted on or before January 6, 2016. Upon motion duly seconded, the bill passed first reading and was referred to the Rules, Confirmations, and Public Elections Committee by a voice vote of the Council.

BILL NO. BL2016-208

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing water main and easement and to accept new water mains, four fire hydrant assemblies and easements for properties located at Division Street and 8th Avenue South (MWS Project No. 16-WL-09 and Proposal No. 2016M-011ES-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning, and Historical and Public Works Committees by a voice vote of the Council.

BILL NO. BL2016-209

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing sewer mains and easements and to accept new sewer mains, easements and manhole assemblies for property located at Jo Johnston Avenue (MWS Project No. 16-SL-32 and Proposal No. 2016M-008ES-001). The bill was approved by the Planning Commission. An ordinance to amend the Geographic Information Systems Street and Alley Centerline Layer for the Metropolitan Government of Nashville and Davidson County by abandoning a portion of Alley No. 934 right-of-way (Proposal Number 2011M-005AB-001).

The bill was approved by the Planning Commission. BILL NO. BL2016-216

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to construct a new water main and to acquire property rights for that project in seven properties located along Bell Road, Mt. View Road, and Hickory Hollow Parkway, either in the form of permanent and temporary construction easements, or fee simple property rights (Project No. 15-WG-0106 and Proposal No. 2016M-009ES-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning, and Historical and Public Works Committees by a voice vote of the Council.

BILL NO. BL2016-217

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R8 to IWD zoning for properties located at 2915, 2917, 2919, 2919B Brick Church Pike and Brick Church Pike (unnumbered), approximately 975 feet north of Fernco Drive (17.46 acres), all of which is described herein (Proposal No. 2016Z-017PR-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning, and Historical Committee by a voice vote of the Council.

BILL NO. BL2016-218

An ordinance amending Chapter 17.40 of Title 17 of the Metropolitan Code, Zoning Regulations, pertaining to the zoning application fees and public hearing notice costs for amendments to the official zoning map initiated by a member or members of the Metropolitan Council (Proposal No. 2016Z-007TX-001). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission and Planning, Zoning, and Historical Commission by a voice vote of the Council.

BILL NO. BL2016-219

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by cancelling a portion of the Forest View Park Planned Unit Development, and by changing from R10 to RS10 zoning for property located at Forest View Drive (unnumbered), approximately 430 feet east of Murfreesboro Pike, zoned R10 (7.84 acres), all of which is described herein. (Proposal No. 23-85P-003) (Proposal No. 2016Z-051PR-001). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission and Planning, Zoning, and Historical Committee by a voice vote of the Council.

- BILLS ON SECOND READING -

BILL NO. BL2016-100

An ordinance amending Section 16.04.070 of the Metropolitan Code of Laws to require the director of the Metropolitan Department of Codes Administration to notify the Metropolitan Council of all building permits and applications under Section 16.28.010. The Codes, Fair, and Farmers Market Committee recommended deferment. Mr. Hagar moved to defer the bill, which motion was seconded and adopted by a voice vote of the Council. Pursuant to Rule No. 23, the bill is deferred indefinitely.

BILL NO. BL2016-123

An ordinance approving Amendment No. 8 to the Rutledge Hill Redevelopment Plan. The Budget and Finance Committee recommended withdrawal. Mr. Mendes moved to withdraw the bill, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2016-158

An ordinance amending Title 2 of the Metropolitan Code of Laws related to the enforcement of the Metropolitan Codes and reporting requirements. The Codes, Fair, and Farmers Market Committee recommended deferment. Ms. Karen Johnson moved to defer the bill, which motion was seconded and adopted by a voice vote of the Council. Pursuant to Rule No. 23, the bill is deferred indefinitely.

BILL NO. BL2016-159

An ordinance amending section 2.24.300 of the Metropolitan Code. The Budget and Finance Committee recommended indefinite deferment at the request of the sponsor. Mr. Cooper moved to defer the bill indefinitely, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-177

An ordinance amending Section 6.28.010 of the Metropolitan Code of Laws with regard to Hotel Register Requirements. The bill was approved by the Public Safety, Beer, and Regulated Beverages Committee. Mr. Pardue moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-178

An ordinance amending Chapter 16.28 of the Metropolitan Code of Laws to require work allowed by demolition permits to commence within 30 days, be completed within 60 days subject to extension, and to be verified by affidavit attesting to the commencement of work. The bill was approved by the Codes, Fair, and Farmers Market Committee with an amendment. Mr. Sledge offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. Mr. Sledge moved to pass the bill on second reading as amended, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-179

An ordinance designating the position of business development officer created by Ordinance No. 88-586 as a position in the classified service. The bill was approved by the Personnel, Public Information, Human Relations, and Housing Committee. Ms. Murphy moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-180

An ordinance authorizing the Metropolitan Government of Nashville and Davidson County to accept a donation of $75,000 from Lenox Village III, LLC, to aid in construction of traffic improvements at the intersection of Nolensville Road and Bienville Drive (Project No. 2016-R-10). The bill was approved by the Budget and Finance and Public Works Committees. Mr. Bedne moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-181

An ordinance approving a lease agreement between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Social Services Department/Metropolitan Homelessness Commission and City Road Chapel United Methodist Church for the use of additional office space (Proposal No. 2016M-009PR-001). The bill was approved by the Planning Commission, Budget and Finance, Health, Hospitals, and Social Services, and Planning, Zoning, and Historical Committees. Mr. Anthony Davis moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.
