ORDINANCE NO. BL2016-176

An ordinance amending section 2.120.100 of the Metropolitan Code pertaining to personnel for the Charter Revision Commission.

WHEREAS, the Metropolitan Government has established a Charter Revision Commission in accordance with section 19.03 of the Charter to hold hearings and to make recommendations to the Metropolitan Council with respect to amendments to the Charter; and,

WHEREAS, the Charter Revision Commission has not been assigned personnel to assist the Commission with administrative functions; and,

WHEREAS, section 18.01 of the Charter provides that the Metropolitan Clerk shall perform such other duties as may be assigned to the Clerk by ordinance; and,

WHEREAS, it is desirable to designate the Metropolitan Clerk’s office to assist the Charter Revision Commission with administrative functions.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That section 2.120.100 of the Metropolitan Code is hereby amended by deleting the following language:

“2.120.100 - Employment of personnel
Except as otherwise provided in the Metropolitan Charter or by ordinance of the metropolitan council, the charter revision commission is authorized to employ such personnel as may be necessary to perform its functions and as may be within the limits of its budget appropriation.”

and substituting in lieu thereof the following language:

“2.120.100 - Personnel
The Metropolitan Clerk or designee shall assist the charter revision commission with the performance of administrative functions. The Metropolitan Clerk or designee shall also serve as the custodian of the minutes and records of the commission.”

Section 2. That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
