ORDINANCE NO. BL2016-100

An ordinance amending Section 16.04.070 of the Metropolitan Code of Laws to require the director of the Metropolitan Department of Codes Administration to notify the Metropolitan Council of all building permits and applications under Section 16.28.010.

WHEREAS, the Metropolitan Department of Codes Administration is responsible, inter alia, for accepting applications and issuing permits to persons desiring to construct, alter, repair, enlarge, move or demolish any building or structure; and

WHEREAS, among the responsibilities of members of the Metropolitan Council is the determination of community and neighborhood preferences and needs regarding new structures, new buildings and the alteration, enlargement or demolition thereof; and

WHEREAS, a key to the determination of community and neighborhood preferences and needs is sufficient and timely notice of development plans submitted to the Department of Codes Administration; and

WHEREAS, on far too frequent occasions, members of the Metropolitan Council learn of new developments within their own districts through sources other than the Department of Codes Administration, including media reports, constituent inquiries, and on-line sources; and

WHEREAS, it is fitting and proper that the Department of Codes Administration provide timely and regular disclosures of the development activities within individual districts to members of the Metropolitan Council so that said members may better represent their constituency.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Section 16.04.070 of the Metropolitan Code of Laws be and the same is hereby amended by adding the following provision at the end thereof:

“The director shall notify the metropolitan council on a monthly basis of all applications and permits issued under Section 16.28.010.”

Section 2. This Ordinance shall take effect from and after its enactment, the welfare of The Metropolitan Council of Nashville and Davidson County requiring it.
