ORDINANCE NO. BL2016-208

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing water main and easement and to accept new water mains, four fire hydrant assemblies and easements for properties located at Division Street and 8th Avenue South (MWS Project No. 16-WL-09 and Proposal No. 2016M-011ES-001).

WHEREAS, the abandonment of approximately 1086 linear feet of existing water main and easement and the acceptance of approximately five linear feet of six inch DIP, and 10 L.F. of 10 inch DIP water main, four new fire hydrant assemblies and easements for four properties located at Division Street and 8th Avenue South (addresses not assigned) are needed to construct project number 16-WL-09; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2016M-011ES-001 on March 23, 2016, for the abandonment and acceptance of said water mains and easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 1086 linear feet of existing water main and easement and to accept approximately five linear feet of six inch DIP, 10 L.F. of 10 inch DIP water main, four new fire hydrant assemblies and easements for four properties located at Division Street and 8th Avenue South (addresses not assigned) as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
