RESOLUTION NO. RS2016-205

A resolution authorizing the Metropolitan Department of Law to compromise and settle the two distinct wage and hour class action claims brought by Vonda Noel on behalf of herself and all other similarly situated Davidson County Sheriff's Office employees against the Metropolitan Government in the amount of $199,936.25 for the Fair Labor Standards Act class; and in the amount of $1,900,000.00 for the Rule 23 unpaid wages class; for a total of $2,099,936.25 to be paid out of the Judgment and Losses Fund.

WHEREAS, Vonda Noel on behalf of herself and others similarly situated Davidson County Sheriff’s Office (“DCSO”) employees filed a lawsuit against the Metropolitan Government consisting of Fair Labor Standards Act (“FLSA”) class action claims and Rule 23 of the Federal Rules Civil Procedure (“Rule 23”) class action claims for unpaid wages; and,

WHEREAS, after investigation, the Metropolitan Department of Law believes that the settlement listed in Section 1 is fair and reasonable and in the best interest of the Metropolitan Government and recommends that the FLSA class claims be compromised and settled in the amount of $199,936.25 and the Rule 23 unpaid wages class claims be compromised and settled in the amount of $1,900,000.00.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: The Metropolitan Department of Law is authorized to compromise and settle the claims of Vonda Noel on behalf of herself and other similarly situated DCSO employees in the amount of $199,936.25 for the FLSA class, and $1,900,000.00 for the Rule 23 unpaid wages class all for a total of $2,099,936.25 to be paid out of the Judgment and Losses Fund.

Section 2: This resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
