ORDINANCE NO. BL2016-216

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to construct a new water main and to acquire property rights for that project in seven properties located along Bell Road, Mt. View Road, and Hickory Hollow Parkway, either in the form of permanent and temporary construction easements, or fee simple property rights (Project No. 15-WG-0106 and Proposal No. 2016M-009ES-001).

WHEREAS, approval for construction of approximately 3,200 linear feet of 16 inch water main and to acquire by condemnation or negotiation property rights in seven properties located along Bell Road, Mt. View Road, and Hickory Hollow Parkway (the “Properties”), either in the form of temporary and permanent easements, or fee simple property rights, is needed for the Bell Road at Hickory Hollow Improvement Project No. 15-WG-0106 (the “Project”); and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2016M-009ES-001 on March 15, 2016, for the construction of said water main and the acquisition of property rights in the Properties by negotiation or condemnation, either in the form of permanent and temporary construction easements, or fee simple property rights, as needed for the Project.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to construct approximately 3,200 linear feet of 16 inch water main and to acquire by negotiation or condemnation property rights in seven properties located along Bell Road, Mt. View Road and Hickory Hollow Parkway, either in the form of temporary and permanent easements, or fee simple property rights; as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the negotiations or condemnation authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
