ORDINANCE NO. BL2016-178

An ordinance amending Chapter 16.28 of the Metropolitan Code of Laws to require work allowed by demolition permits to commence within 30 days, be completed within 60 days subject to extension, and to be verified by affidavit attesting to the commencement of work.

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Chapter 16.28 of the Metropolitan Code of Laws shall be and the same is hereby amended by deleting subsection C of Section 16.28.240 in its entirety and substituting in lieu thereof the following new Subsection C of Section 16.28.240:

C. In the case of a permit issued to demolish a building or structure, such demolition permit shall become invalid unless the work authorized by it shall have been commenced within thirty days after its issuance, or unless the work so authorized shall have been completed within sixty days after work is timely commenced; provided that extensions of time may be allowed as provided in this section. Within thirty days of issuance of any demolition permit, an affidavit shall be submitted to the director certifying the date that demolition has commenced and describing the nature of the work performed to date. If no such affidavit is submitted within thirty days of issuance, the demolition permit shall be deemed invalid.

Section 2. This Ordinance shall take effect from and after its enactment, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1
TO
ORDINANCE NO. BL2016-178

Mr. President –

I move to amend Ordinance No. BL2016-178 as follows:

I. By amending Section 1 by deleting it in its entirety and substituting therefore the following:

Section 1. That Chapter 16.28 of the Metropolitan Code of Laws shall be and the same is hereby amended by deleting subsection C of Section 16.28.240 in its entirety and substituting in lieu thereof the following new Subsection C of Section 16.28.240:

C.
