RESOLUTION NO. RS2016-199

A resolution authorizing the Director of Public Property to exercise an option to purchase a parcel of real property (Parcel ID 03800012600) for use as a public park by The Metropolitan Government of Nashville and Davidson County (Proposal No. 2016M-011PR-001).

WHEREAS, Metropolitan Code of Laws § 2.24.250(F) provides that fixed-price options for the purchase of fee-simple interest in real property to be used for certain purposes may be approved by resolution of the Metropolitan Council; and

WHEREAS, pursuant to the terms of the option agreement (the “Option”) attached as Exhibit A and incorporated into this resolution by reference, the Director of Public Property proposes to purchase a tract of land known as Parcel 126.00 on Davidson County Tax Map 038-00 (also known as 0 Blue Berry Hill Road) located adjacent to and adjoining Beaman Park as shown on Exhibit B; and

WHEREAS, Tennessee Parks and Greenways Foundation desires to sell said tract to the Metropolitan Government for half of its acquisition cost, for the use and benefit of the Metropolitan Board of Parks and Recreation; and,

WHEREAS, the Board of Parks and Recreation recommends that the Metropolitan Government exercise its option to purchase this property; and

WHEREAS, purchase of the Properties is in the best interest of the citizens of the Metropolitan Government.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

Section 1. That the Director of Public Property Administration is hereby authorized to exercise the Option and to receive, execute and record such documents as may be necessary to carry out the purchase of the Property.

Section 2. This Resolution shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson requiring it.
