ORDINANCE NO. BL2016-209

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing sewer mains and easements and to accept new sewer mains, easements and manhole assemblies for property located at Jo Johnston Avenue (MWS Project No. 16-SL-32 and Proposal No. 2016M-008ES-001).

WHEREAS, the abandonment of approximately 566 linear feet of existing eight inch, 618 linear feet of 12 inch, 188 linear feet of 16 inch, and 551 linear feet of 18 inch VCP sanitary sewer main and easements and the acceptance of approximately 872 linear feet of eight inch, 86 linear feet of 10 inch, 530 linear feet of 12 inch, and 869 linear feet of 18 inch sanitary sewer main and easements and 13 new sewer manhole assemblies for property located at Jo Johnston Avenue (unnumbered), are needed to construct MWS Project No. 16-SL-32; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2016M-008ES-001 on March 15, 2016, for the abandonment and acceptance of said sewer mains and easements

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 566 linear feet of existing eight inch, 618 linear feet of 12 inch, 188 linear feet of 16 inch, and 551 linear feet of 18 inch VCP sanitary sewer main and easements and to accept approximately 872 linear feet of eight inch, 86 linear feet of 10 inch, 530 linear feet of 12 inch, and 869 linear feet of 18 inch sanitary sewer main and easements and 13 new sewer manhole assemblies for property located at Jo Johnston Avenue (unnumbered) as shown on Exhibits 1, which is attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
