The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Councilman Brady Banks.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

Please find attached the State of Tennessee reporting form, State Form No. CT-0253, required to be submitted to the local legislative body following the sale of bonds previously authorized by the Metropolitan Council. The report is for the sale of $112,895,000 Electric System Revenue Refunding Bonds, 2015 Series A, which closed on May 19, 2015.

As always, we appreciate the Metropolitan Council’s support in these important financing initiatives.

CATV Special Committee
Appointment of Mr. Joel Sullivan for a term expiring March 1, 2018.. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Harmon moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Board of Health
Appointment of Dr. Margreete Johnson for a term expiring May 30, 2020. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Harmon moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

RESOLUTION NO. RS2015-1520

A resolution adopting Pension Funding Policies for the Metropolitan Government of Nashville and Davidson County, as approved by the Metropolitan Benefit Board. The resolution was approved by the Budget and Finance and Personnel-Public Information-Human Relations-Housing Committees.

RESOLUTION NO. RS2015-1521

A resolution accepting a grant from the State of Tennessee, Department of Labor and Workforce Development, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Career Advancement Center, to establish programs and deliver services to prepare youth for entry into the labor force (LW09P151YOUTH16). The resolution was approved by the Budget and Finance and Personnel-Public Information-Human Relations-Housing Committees.

RESOLUTION NO. RS2015-1522

A resolution approving an application for the Bulletproof Vest Grant from the United States Department of Justice to The Metropolitan Government of Nashville and Davidson County. The resolution was approved by the Budget and Finance and Public Safety-Beer and Regulated Beverages Committees.

RESOLUTION NO. RS2015-1523

A resolution authorizing the consumption of alcoholic beverages on certain premises between a convention center, a convention center hotel, and a museum attached to the convention center hotel. The resolution was approved by the Convention, Tourism and Public Entertainment Facilities and Public Safety-Beer and Regulated Beverages Committees.

RESOLUTION NO. RS2015-1524

A resolution approving a contract with the Tennessee Department of Health for the provision of outpatient ambulatory care, drug assistance, and insurance assistance under the Ryan White program. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2015-1525

A resolution accepting a grant from the United States Environmental Protection Agency to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, for the ongoing collection of data on ambient air concentrations for fine particulate matter in Nashville, Tennessee. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2015-1526

A resolution accepting a grant from the State of Tennessee, Department of Health, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to support the delivery of public health services.
The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2015-1527

A resolution approving Amendment One to a grant from the U.S. Environmental Protection Agency to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to fund an ongoing program to protect air quality to achieve established ambient air standards and protect human health. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2015-1528

A resolution approving a clinical training agreement between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, and Vanderbilt University to provide clinical training experiences to enrolled students of the Vanderbilt University Department of Allied Health. The resolution was approved by the Health, Hospitals and Social Services Committee.

RESOLUTION NO. RS2015-1529

A resolution authorizing the Director of Public Property, or his designee, to acquire certain real property by purchase and/or donation to The Metropolitan Government of Nashville and Davidson County for use as park land (Proposal No. 2015M-014PR-001). The resolution was approved by the Planning Commission, Budget and Finance, Parks, Library and Recreation and Planning, Zoning and Historical Committees.

RESOLUTION NO. RS2015-1530

A resolution accepting a grant from the Tennessee State Library and Archives to The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Public Library, to target library materials to persons having difficulty using a library and to the underserved in the Nashville – Davidson County area. The resolution was approved by the Budget and Finance and Parks, Library and Recreation Committees.

RESOLUTION NO. RS2015-1531

A resolution to approve the second amendment to the lease agreement between the Metropolitan Government of Nashville and Davidson County and Parkway Towers, LLC for the use of parking space in the Parkway Towers’ garage (Proposal Number 2013M-033PR-003). The resolution was approved by the Planning Commission, Budget and Finance and Planning, Zoning and Historical Committees.

RESOLUTION NO. RS2015-1533

A resolution approving an Interlocal Agreement between the State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, acting by and through its Department of Public Works, for resurfacing 1.86 Miles located on Myatt Drive from Anderson Lane to Gallatin Pike SR6 (S.A. 19021 (5). The resolution was approved by the Budget and Finance and Public Works Committees.

RESOLUTION NO. RS2015-1534

A resolution approving an intergovernmental agreement by and between the State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Public Works, for Harding Place Sidewalk Improvements, Phase 3, PIN 121791.00. The resolution was approved by the Budget and Finance and Public Works Committees.

RESOLUTION NO. RS2015-1535

A resolution approving an intergovernmental agreement by and between the State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Public Works, for Lebanon Pike Sidewalk Improvements, PIN 121729.00. RESOLUTION NO. RS2015-1538

A resolution approving an intergovernmental agreement by and between the State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Public Works, for county wide signalized intersection improvements, PIN 111335.01. RESOLUTION NO. RS2015-1539

RESOLUTION NO. RS2015-1540

A resolution approving an Intergovernmental Agreement by and between the State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, acting by and through its Department of Public Works, for the acceptance of a traffic signal at the intersection of SR-11 and Welshwood Drive, State Project No: 19028-3244-94, Federal Project No: HSIP-11(17). The resolution was approved by the Budget and Finance and Public Works Committees.

RESOLUTION NO. RS2015-1541

A resolution authorizing the Metropolitan Department of Law to compromise and settle the Metropolitan Government’s claims against Shlomo Eplboim, Epandco Real Estate, LLC and Epandco Holdings, LLC for the amount of $15,000 and entry of a permanent injunction to monitor future compliance with the Metro Code of Laws. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2015-1542

A resolution honoring Chester R. Green on the occasion of his 100th Birthday. The resolution was approved by the Rules-Confirmations-Public Elections Committee.

A resolution adopting a new pay plan for the general employees of The Metropolitan Government of Nashville and Davidson County, excluding employees of the Board of Health, Board of Education, and the Police and Fire Departments, effective July 1, 2015; and establishing the salary for the position of Mayor, effective upon the beginning of a new elective term for that office.
The resolution was approved by the Budget and Finance and Personnel-Public Information-Human Relations-Housing Committees.

RESOLUTION NO. RS2015-1518

A resolution adopting a new pay plan for employees of The Metropolitan Board of Health, effective July 1, 2015. The resolution was approved by the Budget and Finance, Health, Hospitals and Social Services and Personnel-Public Information-Human Relations-Housing Committees.

RESOLUTION NO. RS2015-1498

A resolution requesting the Metropolitan Civil Service Commission to consider and recommend an amendment to the General Pay Plan to partially base the compensation of Members of the Metropolitan Council upon Council and committee meeting attendance. The Personnel-Public Information-Human Relations-Housing Committee disapproved the resolution. In the absence of the sponsor, the resolution was deferred. Pursuant to Rule No. 23 the resolution was deferred indefinitely.

RESOLUTION NO. RS2015-1515

A resolution requesting the Davidson County Delegation to the Tennessee General Assembly to introduce and support the necessary legislation to require full-time Davidson County elected officials to submit an annual report to the Comptroller detailing the dates they worked. The Rules-Confirmations-Public Elections Committee recommended deferment. In the absence of the sponsor, the resolution was deferred.

BILL NO. BL2015-1212

An ordinance amending Section 7.08.140 of the Metropolitan Code to prohibit the sale of single cans or bottles of beer by off-sale permit holders located within 100 feet of a facility that provides food to homeless persons. Upon motion duly seconded, the bill passed first reading and was referred to the Public Safety-Beer and Regulated Beverages Committee by a voice vote of the Council.

BILL NO. BL2015-1213

An ordinance amending Title 15 the Metropolitan Code pertaining to abandoned water and/or sewer connections, irrigation meter ownership and tap fees. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Public Works Committees by a voice vote of the Council.

BILL NO. BL2015-1214

An ordinance readopting the Code of The Metropolitan Government of Nashville and Davidson County, Tennessee, prepared by Municipal Code Corporation including supplemental and replacement pages thereof, containing certain ordinances of a general and permanent nature enacted on or before March 4, 2015. BILL NO. BL2015-1215

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 3,750 square feet of public utility easement rights that were previously acquired by Council Ordinance No. BL2014-929 for property located at 603 Tuckahoe Drive (Project No. 15-SWC-030). The bill was approved by the Planning Commission. An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to negotiate and accept permanent easements and temporary easements for the Duling Avenue Stormwater Improvement Project for 10 properties located at 201, 210, 212, 214, 216, 218, 229, and 233 Duling Avenue and at 106 and 306 Gallatin Pike (Project No. 15-SWC-168 and Proposal No. 2015M-028ES-001). The bill was approved by the Planning Commission. An ordinance to amend the Geographic Information Systems Street and Alley Centerline Layer for the Metropolitan Government of Nashville and Davidson County by renaming Woodland Point Drive to “Woodland Pointe Drive”, from Bell Road to the cul-de-sac (Proposal No. 2015M-003SR-001). The bill was approved by the Planning Commission, Emergency Communications District Board and the Traffic, Parking and Transportation Committee; the Public Works and Planning, Zoning and Historical Committees recommended deferment. An ordinance amending Chapters 10 and 16 of the Metropolitan Code of Laws to adopt updated fire, building, dwelling, energy, gas/mechanical, and plumbing codes with amendments. BILL NO. BL2015-1146

An ordinance amending Chapter 12.44 of the Metropolitan Code to provide for annually-paid parking for free-floating car-sharing organization vehicles in parking meter zones and amending Section 12.42.070 of the Metropolitan Code to allow free-floating car-sharing vehicles to be exempt from the limitations imposed on vehicles lacking a residential parking permit when parking in a residential parking permit area. The bill was approved by the Budget and Finance, Public Works and Traffic, Parking and Transportation Committees. Ms. Allen moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2015-1147

An ordinance requiring the Metropolitan Planning Department to prepare an amendment to the Metropolitan Zoning Code to require affordable and workforce housing units as part of residential developments, and to establish rules and regulations pertaining to the implementation of such requirements. The bill was approved by the Planning, Zoning and Historical Committees. Mr. Banks moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2015-1148

An ordinance to amend the Geographic Information Systems Street and Alley Centerline Layer for the Metropolitan Government of Nashville and Davidson County by abandoning a portion of Redmon Street right-of-way (Proposal No. 2015M-005AB-001). BILL NO. BL2015-1149

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 1,240 linear feet of sewer main and easement and to accept a new manhole and 30 linear feet of 12 inch DIP sewer main for various properties located along George L Davis Boulevard, 12th Avenue North, and Church Street (MWS Project No. 15-SL-11 and Proposal No. 2015M-026ES-001). The bill was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committees. Ms. Gilmore moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2015-1150

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 126 linear feet of an eight inch sanitary sewer main and easement for property located at Elliott Avenue (unnumbered), (MWS Project No.15-SL-42 and Proposal No. 2015M-025ES-001). The bill was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committee. Mr. Anthony Davis moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2015-1151

An ordinance authorizing the Metropolitan Nashville Police Department to donate certain vests to the Armor of God Project, Inc., for refurbishment and distribution of the vests to under-funded law enforcement entities around the country and world. The bill was approved by the Public Safety-Beer and Regulated Beverages Committees. Mr. Pridemore moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2014-835

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R8 to SP zoning for property located at 1813 Beech Avenue, approximately 390 feet north of Wedgewood Avenue (0.49 acres), to permit up to seven detached residential units, all of which is described herein (Proposal No. 2014SP-033-001).
