RESOLUTION NO. RS2015-1534

A resolution approving an intergovernmental agreement by and between the State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Public Works, for Harding Place Sidewalk Improvements, Phase 3, PIN 121791.00.

WHEREAS, The Metropolitan Government of Nashville and Davidson County and the State of Tennessee, Department of Transportation seek to enter into an intergovernmental agreement for Harding Place Sidewalk Improvements Phase 3, including construction of sidewalks along the south side of Harding Place from Danby Drive to Nolensville Pike with improvements to curb and gutter, ADA accessibility, drainage improvements, pedestrian amenities, pedestrian signalization, crosswalks, lighting, and landscaping, PIN 121791.00; and,

WHEREAS, Tennessee Code Annotated, Section 12-9-104(b) authorizes The Metropolitan Government of Nashville and Davidson County to enter into intergovernmental agreements with the State of Tennessee by resolution; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this intergovernmental agreement be approved.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the intergovernmental agreement by and between the State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Public Works, for Dickerson Pike Sidewalk Improvements, PIN 121791.00, a copy of which is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. Any amendments, renewals, or extension of the terms of the agreement may be approved by resolution of the Metropolitan Council.

Section 3. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
