ORDINANCE NO. BL2015-1217

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to negotiate and accept permanent easements and temporary easements for the Duling Avenue Stormwater Improvement Project for 10 properties located at 201, 210, 212, 214, 216, 218, 229, and 233 Duling Avenue and at 106 and 306 Gallatin Pike (Project No. 15-SWC-168 and Proposal No. 2015M-028ES-001).

WHEREAS, the negotiation and acceptance of permanent easements and temporary easements for 10 properties located at 201, 210, 212, 214, 216, 218, 229, and 233 Duling Avenue and at 106 and 306 Gallatin Pike, are needed to construct the Duling Avenue Stormwater Improvement Project No. 15-SWC-168; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2015M-028ES-001 on May 14, 2015, for the negotiation, condemnation, or fee simple take of permanent easements and temporary easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to negotiate and accept permanent easements and temporary easements for 10 properties located at 201, 210, 212, 214, 216, 218, 229, and 233 Duling Avenue and at 106 and 306 Gallatin Pike as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the negotiation, condemnation, or fee simple take authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
