RESOLUTION NO. RS2015-1537

A resolution approving Amendment Number Two (2) to an intergovernmental agreement between the State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County for funding for various intersections improvements, PIN 111335.00.

WHEREAS, in RS2008-509, the Metropolitan County Council approved an intergovernmental agreement between the State of Tennessee, Department of Transportation (“TDOT”), and The Metropolitan Government for funding of the Preliminary Engineering phase of various intersection improvements for PIN 111335.00 (the “Agreement”); and,

WHEREAS, in RS2012-508, the Metropolitan County Council approved Amendment Number One (1) to the intergovernmental agreement between the State of Tennessee, Department of Transportation, and the Metropolitan Government of Nashville and Davidson County for funding various intersection improvements under PIN 111335.00; and

WHEREAS, the parties seek to amend the agreement by modifying the language of Exhibit A, Project Description Section, for Amendment One (1) for PIN 111335.00, dated January 11, 2013, and by adding Exhibit B; and

WHEREAS, Exhibit B for Amendment Number Two (2) is attached and describes the locations of said improvements; and

WHEREAS, Tennessee Code Annotated, Section 12-9-104(b) authorizes the Metropolitan Government of Nashville and Davidson County to enter into intergovernmental with the State of Tennessee by resolution; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that Amendment Number Two (2) to the Agreement be approved.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the language of Exhibit A for Amendment Number One (1) for PIN 111335.00, dated January 11, 2013 is deleted in its entirety and replaced with Exhibit A (attached) for Amendment Number Two (2); and,

Section 2. That Amendment Number Two (2) to the Agreement between TDOT and The Metropolitan Government, including Exhibit B, for PIN 111335.00, attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 3. That any funds obtained by the Metropolitan Government pursuant to this intergovernmental agreement shall be appropriated to and by the Metropolitan Department of Public Works based on revenues estimated to be received and any match be applied.

Section 3. That this resolution shall take effect from and after its adoption the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
