ORDINANCE NO. BL2015-1126
An ordinance amending Section 5.16.060 of the Metropolitan Code to impose a litigation tax to defray the cost of the salaries of the general sessions court judges.
WHEREAS, Tennessee Code Annotated Section 16-15-5006 provides that a county legislative body, upon approval by a two-thirds (2/3) vote, is authorized to impose a local litigation tax on each civil case filed in general sessions court and on each criminal conviction in general sessions court; and,
WHEREAS, the litigation tax may be in any amount up to six dollars ($6.00) per case; and,
WHEREAS, the proceeds of the litigation tax shall be paid to the county general fund for the purposes of defraying the cost to counties of paying the salaries of the general sessions judges; and,
WHEREAS, it is in the best interest of the citizens of Davidson County that this ordinance be enacted.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That Section 5.15.060 of the Metropolitan Code is hereby amended by adding the following new subsection E.:
E. A two dollar ($2.00) tax on litigation shall be collected for each civil case filed in general sessions court, including Metropolitan Traffic cases. The tax collected by the clerk of the court shall be deposited in the general fund of the general services district. All revenue generated under this litigation tax shall be used exclusively to aid in defraying the costs of general sessions judges’ salaries, pursuant to the terms set forth in Tennessee Code Annotated Section 16-15-5006 and other applicable state law.
Section 2. That this ordinance shall take effect on July 1, 2015, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
