Metropolitan Council Meeting

The Metropolitan Council met in regular session on this date at 7:00 p.m. in Metro City Hall.
The invocation was offered by Councilmember Buck Dozier.
The Metropolitan Council gave the pledge of allegiance to the American Flag.

Please accept this letter as my notice of resignation as Metro Council Representative for District 33, effective March 15, 2006. I have accepted the position of Chief Administrative Officer for the Office of the Criminal Court Clerk.
I would like to take this opportunity to express my sincere appreciation for your guidance and advice during my time on the Council. I also would like for you to know how fortunate I feel to have been associated with such a dedicated group of Council Members who I feel truly care about their respective districts and the City as a whole.

- COMMITTEE REPORTS ON MATTERS OTHER THAN LEGISLATION -
The Rules-Confirmation-Public Elections Committee recommended approval of the following proposed amendments to the Rules of Procedure of the Metropolitan Council:
Rule Nos. 1 and 25:
1. By amending
Rule 1 by deleting "Announcements and extraordinary matters" from
the regular order of
business.
2. By amending the Table of Contents for Rule 25 by renaming it as "Honorarium resolution requirements and presentations; announcements and extraordinary matters".
3. By amending Rule 25 by adding the following new paragraph:
"Announcements and extraordinary matters shall be held thirty (30) minutes prior to all regularly scheduled council meetings. The president pro tem of the Council or his/her designee shall preside over such matters."
Mr. Crafton moved to adopt the proposed amendments to Rule Nos. 1 and 25, which motion was seconded and adopted by the following vote: "Ayes" Dozier, Tucker, Briley, Dread, Craddock, Murray, Jameson, Cole, Forkum, Ryman, Brown, Gotto, Burch, White, Loring, Wallace, Walls, Whitmore, Crafton, Adkins, Foster, Alexander, Kerstetter, Toler, Coleman, Bradley, Williams, Tygard (28); "Noes" Isabel, Greer, Shulman, Wilhoite (4); "Abstaining" Gilmore (1).
The Rules-Confirmation-Public Elections Committee recommended deferment of the following proposed amendment to the Rules of Procedure:
Rule No. 31:
By deleting the first paragraph in its entirety and substituting in lieu thereof the following paragraph:
"Members of the public may address the Council by a majority vote of the Council members present. This restriction does not apply to zoning matters where all parties concerned shall be allowed to speak for two minutes each, however, proponents and opponents shall be limited to a maximum speaking time of twenty minutes per side. The Council may by majority vote extend the foregoing time limitation in increments of ten minutes. The Metropolitan Clerk shall keep time in accordance with this Rule."
Mr. Crafton moved to defer the proposed amendment to Rule No. 31, which motion was seconded and adopted by a voice vote of the Council.

An ordinance amending Title 17 of the Metropolitan Code, Zoning Regulations, by amending Sections 17.40.290 and 17.40.350 to require the zoning administrator to notify district councilmembers upon the filing of applications for special exceptions and variances, all of which is more particularly described herein (Proposal No. 2006Z-005T). The bill was approved by the Planning Commission and Planning, Zoning and Historical Committee. Mr. Wallace requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. Wallace moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R6 and OR20 to CS district properties located at 4605 Georgia Avenue and 600, 602, 606, 608 and 610 47th Avenue North (1.24 acres), all of which is described herein (Proposal No. 2005Z-152U-07). The bill was disapproved by the Planning Commission. Mr. Walls requested a hearing from the public on this bill which had been previously advertised. An ordinance amending Title 16 of the Metropolitan Code by amending Section 16.28.190 relative to demolition permits for historic structures (Proposal No. 2006Z-020T). The bill was approved by the Planning Commission. Ms. Murray requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Ms. Murray moved to defer the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.
An ordinance amending Title 17 of the Metropolitan Code, Zoning Regulations, by amending Section 17.04.060 to modify the definition of "two-family" structure to include two detached dwelling units, all of which is more particularly described herein (Proposal No. 2006Z-022T). The bill was approved by the Planning Commission. Mr. Briley requested a hearing from the public on this bill which had been previously advertised. The bill was approved by the Planning Commission. Mr. Isabel requested a hearing from the public on this bill which had been previously advertised. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R15 to SP zoning properties located at 6949 Highway 70 South and Highway 70 South (unnumbered), approximately 2,245 feet east of Old Hickory Boulevard (19.8 acres), to permit 16 cottages and 19 townhouses for a total of 35 dwelling units, all of which is described herein (Proposal No. 2006Z-010G-06). An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R10 to CL (3.47 acres) and RM9 (6.0 acres) district property located at 420 and 424 Donelson Pike and Donelson Pike (unnumbered), approximately 150 feet south of Lakeland Drive (9.47 acres total), all of which is described herein (Proposal No. 2005Z-169U-14). The bill was disapproved by the Planning Commission.
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by making applicable the provisions of a Planned Unit Development located at 420 and 424 Donelson Pike and Donelson Pike (unnumbered), to permit 8,000 sq. ft. restaurant, 5,500 sq. ft. bank, and 54 multi-family units, (9.46) acres, all of which is described herein (Proposal No. 2005P-033U-14). The bill was disapproved by the Planning Commission.

An ordinance to amend various sections of Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, relative to the minimum lot sizes permitted in zoning districts allowing multi-family housing, all of which is more particularly described herein (Proposal No. 2006Z-015T). The bill was approved by the Planning Commission. Mr. Cole requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and a citizen was heard in favor of the bill. The President declared the public hearing closed. An ordinance amending Chapters 17.04, 17.08, 17.16 and 17.20 of Title 17 of the Metropolitan Code, Zoning Regulations, pertaining to automobile repair, service, and sales uses by making certain automobile repair, services, and sales uses permitted only within the Specific Plan (SP) district, and by modifying the definition of these uses and land use tables accordingly, all of which is more specifically described herein (Proposal No. 2006Z-029T). The bill was approved by the Planning Commission. Ms. McClendon requested a hearing from the public on this bill which had been previously advertised. An ordinance amending Chapters 17.04, 17.08, 17.16 and 17.20 of Title 17 of the Metropolitan Code, Zoning Regulations, to add the use "Donation center, drop-off" as a use permitted with conditions in the MUL, MUG, MUI, CL, CS, CA, CF, CC, SCC, SCR, IWD, IR and IG districts, and by adding certain conditions and parking requirements for such use, all of which is more specifically described herein (Proposal No. 2006Z-039T). The bill was approved by the Planning Commission. Mr. Briley requested a hearing from the public on this bill which had been previously advertised. An ordinance amending Title 17 of the Metropolitan Code, Zoning Regulations, by amending Section 17.32.050 to permit signs with graphics or electronic displays along a four-lane or controlled access highway, all of which is more specifically described herein (Proposal No. 2005Z-056T). The bill was disapproved by the Planning Commission. Mr. Dozier requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in opposition to the bill. The President declared the public hearing closed. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of the Metropolitan Government of Nashville and Davidson County, to change the number of years an affordable housing unit must remain affordable granted under Special Floor Area and Development Bonus provisions in the Zoning Code (Proposal No. 2005Z-106T). The bill was approved by the Planning Commission.
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of the Metropolitan Government of Nashville and Davidson County, by changing from RM9 to MUG district properties located at 1501 8th Avenue North and 1507 8th Avenue North, opposite Hume Street (.99 acres), all of which is described herein (Proposal No. 2006Z-009U-08). The bill was approved by the Planning Commission.

A resolution recognizing the contributions, services and memory of Councilman Chester Hughes of Nashville, Tennessee. Mr. Coleman moved to defer the resolution, which motion was seconded and adopted by a voice vote of the Council.
A resolution recognizing Samuel Frey on being named "Teacher of the Year" for 2006-2007 at Jere Baxter Middle School. The Rules-Confirmation-Public Elections Committee recommended deferment. Without objection the resolution was deferred by a voice vote of the Council.
A resolution recognizing Anna Fleming, Kim Phelps, Kenichi Saito, Amanda Rene Walker, and Lizzy Solomon on winning honors in the Nashville Symphony essay contest. Mr. Adkins offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. An ordinance amending Chapter 2.28 of the Metropolitan Code of Laws to require the Metropolitan Fire Marshal to maintain a record of all blasting permit information, which is to be available for public inspection. Upon motion duly seconded, the bill passed first reading and was referred to the Public Safety-Beer and Regulated Beverages Committee by a voice vote of the Council.
An ordinance authorizing
the acquisition of property by negotiation or condemnation for use in the public
projects for The Metropolitan Government of Nashville and Davidson County and
initially with relation to the expansion of Fire Station #16 located in the
Belmont-Hillsboro area (Proposal No. 2006M-027U-10). Upon motion duly seconded,
the bill passed first reading and was referred to the Planning Commission, Budget
and Finance, Public Safety-Beer and Regulated Beverages and Planning, Zoning
and Historical Committees by a voice vote of the Council.

An ordinance authorizing the Metropolitan Government to participate with Pulte Homes, Tennessee LP, to provide public sewer service in Williamson County to Winterset Woods Section II, Project No. 05-SL-100. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Public Works Committees by a voice vote of the Council.
An ordinance to amend the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County, by abandoning Alley #188 right-of-way from 3rd Avenue North to 4th Avenue North, all of which is more particularly described herein (Proposal No. 2006M-007U-08). The bill was approved by Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Traffic and Parking Commission, Public Works, Traffic and Parking, and Planning, Zoning and Historical Committees by a voice vote of the Council.

An ordinance to amend the Geographical Information Systems Map for The Metropolitan Government of Nashville and Davidson County, by renaming the private roads, Garland Avenue from 21st Avenue South to 22nd Avenue South and renaming 22nd Avenue South from Garland Avenue to Blakemore Avenue to Medical Center Drive (Proposal No. 2006M-009U-10). The bill was approved by Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Emergency Communications District Board, Traffic and Parking Commission, Public Works, Traffic and Parking, and Planning, Zoning and Historical Committees by a voice vote of the Council.
Mr. Wallace moved that the dates of the following 2006 Council meetings be changed because of conflicts with a holiday and scheduled elections, which motion was seconded and adopted by a unanimous vote of the Council.
