ORDINANCE NO. BL2006-961
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS5 to SP district, property located at 106 Glenrose Avenue, approximately 185 feet east of Foster Avenue (0.24 acres), to permit a building/contractor supply use, office use, and/or residential use, all of which is described here in (Proposal No. 2005SP-178U-11).
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County, is hereby amended by changing the Official Zoning Map for Metropolitan Nashville and Davidson County, which is made a part of Title 17 by reference, as follows:
By changing from RS5 to SP zoning, property located at 106 Glenrose Avenue, approximately 185 feet east of Foster Avenue (0.24 acres), to permit a building/contractor supply use, office use, and/or residential use, as being Property Parcel No. 026 as designated on Map 119-01 of the Official Property Identification Maps of The Metropolitan Government of Nashville and Davidson County, all of which is described by lines, words and figures on the plan that was duly considered by the Metropolitan Planning Commission, and which is on file with the Metropolitan Planning Department and made a part of this ordinance as though copied herein.
Section 2. Be it further enacted, that the Metropolitan Clerk is hereby authorized and directed, upon the enactment and approval of this ordinance, to cause the change to be made on Sheet No. 119 of said Official Zoning Map for Metropolitan Nashville and Davidson County, as set out in Section 1 of this ordinance, and to make notation thereon of reference to the date of passage and approval of this amendatory ordinance.
Section 3. Be it further enacted that the following conditions be made part of this ordinance:
1. The only allowed
use is Office, Building Contractor Supply, and Residential (single-family or
live work). There shall be no car lots, automotive repair, fast food, or bar/nightclub
permitted.
2. MUN is the fall back zone district.
3. The existing structure is to remain.
4. No more than 1,000 sq. ft. of additional floor area is allowed. Any addition
must be located within the rear yard, behind the existing structure, and can
be attached or detached.
5. All new development must meet the Metro Stormwater Regulations.
6. Any form of outside storage is prohibited.
7. No additional access to Glenrose Avenue is allowed.
8. Parking is only allowed within the side and rear yard.
9. A "B-5" class buffer yard is required along the western property
line.
10. Setbacks are
as follows from the property line:
a. Front: 20 feet
b. Rear: 15 feet
c. East: None
d. West: 5 feet
11. No razor wire fence shall be permitted.
Section 4. Be it further enacted, that this ordinance take effect immediately after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
