ORDINANCE NO. BL2005-910

An Ordinance amending Title 17 of the Metropolitan Code, Zoning Regulations, by amending Sections 17.40.290 and 17.40.350 to require the zoning administrator to notify district councilmembers upon the filing of applications for special exceptions and variances, all of which is more particularly described herein (Proposal No. 2006Z-005T).

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the codification of Title 17 of the Code of The Metropolitan Government of Nashville and Davidson County, Zoning Regulations, be and the same is hereby amended as follows:

1. By amending section 17.40.290 by adding the following provision at the end thereof:

"Within three (3) business days from the date the application for a special exception is filed, the zoning administrator shall notify the district councilmember in writing as to the substance of the request, whether construction on the property necessitating the special exception has commenced, and whether the property owner has been cited for a violation of the zoning code which led to the filing of the application."

2. By amending section 17.40.350 by adding the following provision at the end thereof:

"Within three (3) business days from the date the application for a variance is filed, the zoning administrator shall notify the district councilmember in writing as to the substance of the request, whether construction on the property necessitating the variance has commenced, and whether the property owner has been cited for a violation of the zoning code which led to the filing of the application."

Section 2. That this Ordinance shall take effect five (5) days from and after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
