ORDINANCE NO. BL2006-973

An Ordinance amending Chapters 17.04, 17.08, 17.16 and 17.20 of Title 17 of the Metropolitan Code, Zoning Regulations, to add the use "Donation center, drop-off" as a use permitted with conditions in the MUL, MUG, MUI, CL, CS, CA, CF, CC, SCC, SCR, IWD, IR AND IG districts, and by adding certain conditions and parking requirements for such use, all of which is more specifically described herein (Proposal No. 2006Z-039T).

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the codification of Title 17 of the Code of The Metropolitan Government of Nashville and Davidson County, Zoning Regulations, be and the same is hereby amended by amending Section 17.04.060 by adding the following new definition of "Donation center, drop-off":

"Donation center, drop-off" means any lot, building, structure or premises used solely for the collection of clothing furniture, housewares, small electrical appliances, household textiles, toys, and other small household items. The center shall not pay for materials collected or sell any collected materials on the premises. Collected materials shall be stored in an enclosed location on-site until picked up and taken to a central sorting and distribution center. Types of drop-off donation centers range from storefront centers, which may include a drive-thru facility, to other enclosed facilities."

Section 2. That the codification of Title 17 of the Code of The Metropolitan Government of Nashville and Davidson County, Zoning Regulations, be and the same is hereby amended by amending Section 17.08.030, District Land Use Tables, by adding under "Commercial uses" the use "Donation center, drop-off" as "PC" (permitted with conditions) in the MUL, MUG, MUI, CL, CS, CA, CF, CC, SCC, SCR, IWD, IR, and IG districts.

Section 3. That the codification of Title 17 of the Code of The Metropolitan Government of Nashville and Davidson County, Zoning Regulations, be and the same is hereby amended by amending Section 17.16.070, Land Use Development Standards, by making the following changes under "Commercial Uses":

1. Reletter the existing subsection H., "Home Improvement Sales", as subsection I., and reletter the subsequent subsections of this section accordingly.

2. Add the following new subsection H.:
"H. Donation center, Drop-off.

1. Hours of operation. The donation center shall generally operate during the hours of nine a.m. to six p.m., seven days a week. Notwithstanding the foregoing provision to the contrary,

the hours of operation may be adjusted to assure a high level of donor service and to maintain the premises in a clean and orderly manner.
2. No retail sales shall be conducted at the center.
3. No sorting or distribution of collected materials may occur on-site.
4. No hazardous materials, autos or auto parts, bathroom or kitchen fixtures, guns, large appliances, mattresses and box springs, carpeting, construction materials, or office equipment shall be accepted for donation.
5. All collected materials shall be picked up from the center at least once a week.
6. Illegally dumped items shall be picked up nightly, seven days a week, or as required to maintain a neat and orderly appearance.

Section 4. That the codification of Title 17 of the Code of The Metropolitan Government of Nashville and Davidson County, Zoning Regulations, be and the same is hereby amended by amending Table 17.20.030, PARKING REQUIREMENTS, by adding the land use "Donation center, drop-off" under "Commercial Uses" with the following requirements:

"1 space per 200 square feet"

Section 5. That this Ordinance shall take effect five (5) days from and after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Mr. President:

I move to amend Ordinance No. BL2006-973 by amending Section 3, subsection 2, by adding the following provision at the end of the new subsection H.:

"7. Street Standard. At a minimum, donation centers shall have driveway access on an arterial street."
