The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Councilman Scott Davis.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

Dear Vice Mayor Briley and Members of the Council:

Please find attached the State of Tennessee reporting form required to be submitted to the local legislative body following a sale of bonds. This report is for the sale of $89,420,000 Water and Sewer Revenue Bonds, Series 2017A (Green Bonds) and $155,210,000 Water and Sewer Revenue Bonds, Series 2017B approved by the Metropolitan Council by Resolution No. RS2017-902 on October 3, 2017. The bonds closed on November 2, 2017.

The bonds were sold through a negotiated process on October 25, 2017, at a true interest cost of 3.638173%.

As always, we appreciate the Metropolitan Council’s support on these important financing initiatives.

ELECTIONS AND CONFIRMATIONS

CATV Special Committee
Appointment of Mr. Mark Rowan for a term expiring March 1, 2018. Mr. Rowan will fill the unexpired term of Ms. Jackie Shrago. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Ms. Haywood moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Social Services Commission
Appointment of Mr. Phillip Orr for a term expiring April 3, 2019. Mr. Orr will fill the unexpired term of Dr. Frank Boehm. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Ms. Haywood moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Sports Authority
Reappointment of Mr. Chuck Meriwether for a term expiring October 19, 2023. The Rules, Confirmations, and Public Elections Committee recommended the reappointment. Ms. Haywood moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

President Pro Tempore Weiner assumed the Chair at this time.

RESOLUTION NO. RS2017-937

A resolution exempting Peninsula located at 1035 West Eastland Avenue from the minimum distance requirements for obtaining a beer permit pursuant to Section 7.08.090.E. of the Metropolitan Code. Mr. Scott Davis requested a hearing from the public on this resolution which had been previously advertised. The President asked if anyone desired to be heard for or against the resolution and no one came forward to be heard. The President declared the public hearing closed. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R6-A to SP zoning on properties located at 530, 534, and 536 Southgate Avenue, approximately 305 feet east of Martin Street, (1.73 acres), to permit up to 49 multi-family units, all of which is described herein (Proposal No. 2017SP-054-001). The bill was approved by the Planning Commission with conditions, disapproved without. Mr. Sledge requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed.
Mr. Sledge moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2017-893

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R40 to SP zoning on property located at Edmondson Pike (unnumbered), at the northwest corner of Edmondson Pike and Cloverland Drive (15.1 acres), to permit an assisted living facility, all of which is described herein (Proposal No. 2017SP-068-001). The bill was approved by the Planning Commission with conditions, disapproved without. Ms. Blalock moved to defer the bill to the January public hearing, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2017-902

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from IR to SP zoning on property located at 905 Cherokee Avenue, west of the terminus of Delmas Avenue (5.94 acres), to permit up to 166 multi-family residential units and 23,700 square feet of non-residential units, all of which is described herein (Proposal No. 2017SP-071-001). An ordinance amending Title 17 of the Metropolitan Code of Laws, Zoning Code, pertaining to lighting (Proposal No. 2017Z-022TX-001). The bill was approved by the Planning Commission. Ms. Vercher requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Ms. Vercher moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2017-916

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from CL to MUL-A zoning on property located at 2006 South Hamilton Road, approximately 100 feet southwest of Clarksville Pike (0.27 acres), all of which is described herein (Proposal No. 2017Z-081PR-001). The bill was approved by the Planning Commission. Mr. Hastings moved to defer the bill to the December public hearing, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2017-917

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from CS and RS7.5 to SP zoning on properties located at 3474 Dickerson Pike and Dickerson Pike (unnumbered), west of the terminus of Old Due West Avenue (18.04 acres), to permit the development of up to 267 multi-family units, clubhouse, associated amenities and up to 15,000 square feet of commercial space along Dickerson Pike, all of which is described herein (Proposal No. 2017SP-051-001). BILL NO. BL2017-918

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS5 to SP zoning on a portion of property located at East Trinity Lane (unnumbered), at the southeast corner of East Trinity Lane and Edwin Street (10.08 acres), to permit up to 190 multi-family residential units, all of which is described herein (Proposal No. 2017SP-035-001). An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by cancelling a portion of a Planned Unit Development Overlay District on properties located at Old Hickory Boulevard (unnumbered), approximately 985 feet east of Nolensville Pike, zoned SCR (4.22 acres), all of which is described herein (Proposal No. 89P-013-001). The bill was approved by the Planning Commission.

BILL NO. BL2017-928

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from SCR to SP zoning on property located at Old Hickory Boulevard (unnumbered), approximately 995 feet east of Nolensville Pike, within a Planned Unit Development Overlay District (4.22 acres), to permit a self-service storage facility, all of which is described herein (Proposal No. 2017SP-083-001). The bill was approved by the Planning Commission with conditions, disapproved without.

The bill was approved by the Planning Commission with conditions, disapproved without. Mr. Leonardo requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in favor of passage of the bill. The President declared the public hearing closed.
Mr. Leonardo moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2017-931

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R15 to SP zoning on property located at 7341 Charlotte Pike, approximately 615 feet west of Old Hickory Boulevard (2.87 acres), to permit up to 27 multi-family units, all of which is described herein (Proposal No. 2017SP-082-001). The bill was approved by the Planning Commission with conditions, disapproved without. Ms. Weiner moved to defer the bill to the December public hearing, which motion was seconded and approved by a voice vote of the Council.

SUBSTITUTE BILL NO. BL2017-932

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R6 to R6-A zoning for various properties located along Buchanan Street, Hume Street, Garfield Street, 3rd Avenue North, 4th Avenue North, 5th Avenue North, 6th Avenue North, and 7th Avenue North, southwest of the intersection of I-65 and 3rd Avenue North (58.97 acres), all of which is described herein (Proposal No. 2017Z-110PR-001). The bill was approved by the Planning Commission. Mr. O’Connell requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. BILL NO. BL2017-937

An ordinance amending Title 6 and sections 17.04.060, 17.08.030, 17.16.250, and 17.16.070 of the Metropolitan Code of Laws to add a new Chapter 6.83 pertaining to a short term rental properties advisory committee and to establish regulations regarding short term rental properties (Proposal No. 2017Z-024TX-001). Mr. Shulman offered a substitute ordinance and moved that it be accepted for filing, which motion was seconded and adopted by a voice vote of the Council.

SUBSTITUTE BILL NO. BL2017-937

An ordinance amending Title 6 and sections 17.04.060, 17.08.030, 17.16.250, and 17.16.070 of the Metropolitan Code of Laws to establish regulations regarding short term rental properties and to establish distinct land uses for “Short term rental property – Owner-Occupied” and “Short term rental property – Not Owner-Occupied.” (Proposal No. 2017Z-024TX-001). Mr. Shulman moved to defer the bill to the December public hearing, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2017-938

An ordinance amending Section 17.20.120 of the Metropolitan Code of Laws, pertaining to sidewalks, to establish an exemption for religious institutions in the General Services District within prescribed settings (Proposal No. 2017Z-023TX-001).
