ORDINANCE BL2017-958

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing easement rights for a former 18 inch water main easement for 12 properties located along St. Francis Avenue, Park Circle, Acklen Park Drive and Wrenwood Drive (MWS Project No. 98-WG-004H and Proposal No. 2017M-061ES-001).

WHEREAS, easement rights for a former 18 inch water main easement for twelve properties located at 401 St. Francis Avenue, 605 Park Circle, 402, 407, 408, 411, 413, 415, 417, 3212 Acklen Park Drive, Acklen Park Drive (unnumbered) and 3512 Wrenwood Drive, are no longer needed; and,

WHEREAS, the abandonment had been requested by Metro Water Services, on behalf of the owners; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2017M-061ES-001 on September 12, 2017, for the abandonment of said easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon easement rights for a former 18 inch water main easement for twelve properties located at 401 St. Francis Avenue, 605 Park Circle, 402, 407, 408, 411, 413, 415, 417, 3212 Acklen Park Drive, Acklen Park Drive (unnumbered) and 3512 Wrenwood Drive, as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
