RESOLUTION RS2017-941

A resolution approving a contract between the Tennessee Emergency Management Agency and The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Water and Sewerage Services, to utilize unused funds from a grant previously approved by RS2011-1724 and RS2016-232, to complete the purchase and removal of 15 previously identified properties, including vacant lots, located in various floodway and floodplain areas in Davidson County.

WHEREAS, the Metropolitan Council previously enacted Ordinance BL2010-765 which authorized the Department of Water and Sewerage Services to apply for federal and state funds to acquire interests in and demolish flood-damaged properties pursuant to a hazard mitigation grant program upon approval of a resolution by the Metropolitan Council receiving at least twenty-one affirmative votes; and,

WHEREAS, Tennessee Emergency Management Agency (“TEMA”) and the Department of Water and Sewerage Services (“MWS”) wishes to enter into the contract attached hereto, and incorporated herein, to utilize unused funds from a grant previously approved by RS2011-1724 and RS2016-232, to complete the purchase and removal of 15 previously identified properties; and,

WHEREAS, this contract authorizes the use of unused funds in an amount not to exceed $1,206,363.66, with a required cash match of $172,337.66, to complete the purchase and removal of 15 previously identified properties; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this contract be approved and submitted and that the Department of Water and Sewerage Services be authorized to complete the acquisition and demolition of the previously identified properties.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the contract between Tennessee Emergency Management Agency and The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Water and Sewerage Services, for the utilization of unused grant funds and the completion of the purchase and removal of 15 previously identified houses located in various floodway and floodplain areas in Davidson County, a copy of which is attached hereto and incorporated herein, is hereby approved, and Director of the Department of Water and Sewerage Services is authorized to sign and submit said contract to the Tennessee Emergency Management Agency.

Section 2. That, notwithstanding the provisions of Section 2.24.250.F of the Metropolitan Code to the contrary, Department of Water and Sewerage Services is hereby authorized to acquire interests in the real property identified in the contract, attached hereto and incorporated herein, and to execute all other necessary actions pursuant to the hazard mitigation grant program using federal and/or state grant funds received by the Metropolitan Government for such purpose.

Section 3. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
