ORDINANCE BL2017-913

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing sanitary sewer and water mains, sanitary sewer manholes, fire hydrants and easements and to accept new sanitary sewer and water mains, sanitary sewer manholes, fire hydrants and any associated easements for properties located at 620 S. 9th Street and 804 Sylvan Street (MWS Project Nos. 17-WL-42 and 17-SL-54 and Proposal No. 2017M-060ES-001).

WHEREAS, the abandonment of approximately 222 linear feet of eight inch sanitary sewer main, approximately 380 linear feet of 12 inch water main, approximately 705 linear feet of six inch water main, three sanitary sewer manholes, two fire hydrants and easements, and the acceptance of approximately 421 linear feet of eight inch sanitary sewer main (PVC), approximately 79 linear feet of eight inch sanitary sewer main (DIP), approximately 528 linear feet of 12 inch water main (DIP), approximately 1,083 linear feet of eight inch water main (DIP), five sanitary sewer manholes, five fire hydrant assemblies and any associate easements, for properties located at 620 S. 9th Street and 804 Sylvan Street are needed to construct project numbers 17-WL-42 and 17-SL-54; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2017M-060ES-001 on September 7, 2017, for the abandonment and acceptance of said sanitary sewer and water mains, sanitary sewer manholes, fire hydrants, and easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 222 linear feet of eight inch sanitary sewer main, approximately 380 linear feet of 12 inch water main, approximately 705 linear feet of six inch water main, three sanitary sewer manholes, two fire hydrants and easements, and to accept approximately 421 linear feet of eight inch sanitary sewer main (PVC), approximately 79 linear feet of eight inch sanitary sewer main (DIP), approximately 528 linear feet of 12 inch water main (DIP), approximately 1,083 linear feet of eight inch water main(DIP), five sanitary sewer manholes, five fire hydrant assemblies and any associate easements, for properties located at 620 S. 9th Street and 804 Sylvan Street as shown on Exhibit 1, which is attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
