ORDINANCE BL2017-950

An ordinance, subject to the Charter provision requiring no fewer than 27 (twenty-seven) votes for passage, approving, if at all, the demolition of certain premises of the Fairgrounds as proposed in Resolution No. RS2017-910.

WHEREAS, section 11.602(d) of the Metropolitan Charter provides:

“All activities being conducted on the premises of the Tennessee State Fairgrounds as of December 31, 2010, including, but not limited to, the Tennessee State Fair, Expo Center Events, Flea Markets, and Auto Racing, shall be continued on the same site. No demolition of the premises shall be allowed to occur without approval by ordinance receiving 27 votes by the Metropolitan Council or amendment to the Metropolitan Charter.”; and

WHEREAS, presently pending before the Metropolitan Council is Resolution no. RS2017-910 which -- in seeking approval for issuance of revenue improvement bonds to pay, among other items, costs to acquire, construct, improve, renovate and equip a Major League Soccer stadium -- anticipates eventual demolition of a portion of the Fairgrounds premises.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: That the Metropolitan Council, pursuant to Section 11.602(d) of the Metropolitan Charter, hereby approves the demolition of such Fairgrounds premises as are necessary to construct, improve, renovate and equip the Major League soccer stadium and stadium-related infrastructure referenced in Resolution No. RS2017-910. Failure to receive 27 votes in the affirmative for this ordinance shall mean that any current or future demolition and subsequent construction activities referenced in Resolution No. RS2017-910 shall be suspended.

Section 2: That this Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
