Metropolitan Council Meeting

The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by singer Lari White.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

- ELECTIONS AND CONFIRMATIONS -

Community Corrections Advisory Board
Appointment of Ms. Donna Grayer for a term expiring October 18, 2018. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Community Education Commission
Appointment of Ms. Karla Coleman Garcia for a term expiring October 6, 2018. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Metropolitan Housing Trust Fund Commission
Reappointment of Ms. Lara Tucker for a term expiring September 17, 2021. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Metropolitan Sports Authority
Appointment of Dr. Catana Starks for a term expiring December 19, 2017. Dr. Starks will fill the unexpired term of Mr. Edward S. Temple. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Wastewater Hearing Authority
Reappointment of Ms. Ruthie Cherry for a term expiring October 1, 2018. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

- RESOLUTION ON PUBLIC HEARING-

RESOLUTION NO. RS2016-397

A resolution exempting 5th and Taylor, LLC located at 1411 Fifth Avenue North, from the minimum distance requirements for obtaining a beer permit pursuant to Section 7.08.090.E. of the Metropolitan Code. Mr. O’Connell requested a hearing from the public on this resolution which had been previously advertised. The President asked if anyone desired to be heard for or against the resolution and no one came forward to be heard. The President declared the public hearing closed. The Public Safety, Beer, and Regulated Beverages Committee recommended deferment. Mr. O’Connell moved to defer the resolution to the second meeting in November, which motion was seconded and approved by a voice vote of the Council.

- CONSENT AGENDA RESOLUTIONS -

RESOLUTION NO. RS2016-398

A resolution approving an agreement between Bridgestone Americas, Inc. and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Arts Commission, for the donation of six artworks to be installed and displayed in locations throughout Metro. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2016-399

A resolution amending the economic and community development incentive grant made to the Industrial Development Board of The Metropolitan Government of Nashville and Davidson County for the benefit of Bridgestone Americas, Inc. and its affiliates. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2016-400

A resolution approving a contract by and between The Metropolitan Government of Nashville and Davidson County and Remotec, Inc., to provide the AndrosFX robotic platform, tools, and accessories utilized by the Hazardous Devices Unit of the Metropolitan Nashville Police Department. The resolution was approved by the Budget and Finance and Public Safety, Beer, and Regulated Beverages Committees.

RESOLUTION NO. RS2016-401

A resolution approving a contract between the Metropolitan Government of Nashville and Davidson County and Workbay LLC to provide an integrated workforce development platform for the Opportunity Now Internship Program. The resolution was approved by the Budget and Finance and Personnel, Public Information, Human Relations, and Housing Committees.

RESOLUTION NO. RS2016-402

A resolution accepting a Tennessee Cooperative Agreement to Benefit Homeless Individuals (TN-CABHI) Grant which is a jointly funded program from the State of Tennessee, Department of Mental Health, and Substance Abuse Services to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Social Services Commission, to enhance or develop the infrastructure of Tennessee and the treatment service systems for the population (service recipients). The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2016-403

A resolution approving Amendment One to a contract by and between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, and Vanderbilt University, acting by and through the School of Medicine, to participate as a member site in the CDC Tuberculosis Trials Consortium studies. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2016-404

A resolution approving Amendment One to a grant from the State of Tennessee, Department of Health, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to ensure federal preparedness funds are directed to Tennessee Regional and Metropolitan Emergency Preparedness programs to prepare for, respond to, and recover from public health threats. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2016-405

A resolution approving Amendment Two to a grant from the State of Tennessee, Department of Health, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to provide nutrition education and services to eligible women, infants, and children (WIC), and breast feeding peer counseling programs for citizens of Davidson County.

RESOLUTION NO. RS2016-407

A resolution accepting a Keep America Beautiful/Lowe’s Community Partner Grant to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Public Works Department, to plant 55 trees in 11 Metropolitan Nashville Public Schools during the Hands on Nashville Day. The resolution was approved by the Budget and Finance and Public Works Committees.

RESOLUTION NO. RS2016-408

A resolution requesting the Metropolitan Nashville Police Department to track misdemeanor citations and civil citations for marijuana possession by race, gender and age, and to prepare a report to the Metropolitan County Council, and requesting the related assistance of the District Attorney General of Metropolitan Nashville & Davidson County and the Davidson County Circuit Court Clerk. The resolution was approved by the Public Safety, Beer, and Regulated Beverages Committee.

RESOLUTION NO. RS2016-409

A resolution recognizing the 25th Anniversary of The Tennessee Tribune. The resolution was approved by the Rules, Confirmations, and Public Elections Committee.

RESOLUTION NO. RS2016-410

A resolution to acknowledge the significant cultural contributions and tourism impact of the Americana Music Association, its volunteer Board of Directors, and Executive Director Jed Hilly. The resolution was approved by the Rules, Confirmations, and Public Elections Committee.

- RESOLUTIONS -

RESOLUTION NO. RS2016-378

A resolution approving a memorandum of agreement between Access Fiber Group, Inc. and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Historical and Historic Zoning Commissions, for the commissioning of an Economic Impact Study and a monetary contribution for the purchase of a historical marker at Fort Nashborough. The resolution was approved by the Budget and Finance Committee. The Planning, Zoning, and Historical Committee deferred for a lack of quorum. Mr. Cooper moved to defer the resolution, which motion was seconded and approved by a voice vote of the Council.

RESOLUTION NO. RS2016-406

A resolution allowing exemption of motor vehicles registered in Davidson County that are three (3) or less model years old from the required vehicle inspection and maintenance program to attain or maintain compliance with national ambient air standards. The Health, Hospitals, and Social Services Committee recommended deferment. Ms. Gilmore moved to defer the resolution, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-454

An ordinance amending Section 7.08.090 of the Metropolitan Code to remove the requirement that restaurants possess a license issued by the state alcoholic beverage commission for sale and consumption of wine or other alcoholic beverages on the premises in order to obtain an exemption to the minimum distance requirements for beer sales. Upon motion duly seconded, the bill passed first reading and was referred to the Public Safety, Beer, and Regulated Beverages Committee by a voice vote of the Council.

BILL NO. BL2016-455

An ordinance extending the boundaries of the Urban Services District within the jurisdiction of the Metropolitan Government of Nashville and Davidson County to include certain properties located in Council Districts 7, 8, 9, 13, 14, 15, 31, as more particularly described herein (Proposal No. 2016USD-001-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Planning, Zoning, and Historical Committee by a voice vote of the Council.

BILL NO. BL2016-456

An ordinance authorizing the acceptance of certain property known as Map 105-09 Parcel 286 from the Metropolitan Development and Housing Agency to the Metropolitan Government of Nashville and Davidson County (Proposal No. 2016M-029PR-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Planning, Zoning, and Historical Committees by a voice vote of the Council.

BILL NO. BL2016-457

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing sewer and water main and sanitary manhole and to accept new sanitary manholes and any associated easements for properties located at 1 University Park Drive and 3704 Rosemont Avenue, (MWS Project No. 16-WL-143 and 16-SL-161 and Proposal No.2016M-046ES-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning, and Historical and Public Works Committees by a voice vote of the Council.

BILL NO. BL2016-458

An ordinance approving Amendment One to the Ground Lease for Rose Park between the Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Parks and Recreation, and Belmont University (Proposal No. 2016M-019PR-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance, Parks, Library, and Recreation, and Planning, Zoning, and Historical Committees by a voice vote of the Council.

BILL NO. BL2016-459

An ordinance approving a revocable license agreement between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Human Resources and Operation Stand Down Tennessee for the use of office space (Proposal No. 2016M-034PR-001). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission, Personnel, Public Information, Human Relations, and Housing, and Planning, Zoning, and Historical Committees by a voice vote of the Council.

BILL NO. BL2016-460

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RM20 to R8 and R6 zoning for properties located along Linmar Avenue and Marlin Avenue, east of Sharondale Drive (1.25 acres), all of which is described herein (Proposal No. 2016Z-130PR-001). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission and Planning, Zoning, and Historical Committee by a voice vote of the Council.

BILL NO. BL2016-302

An ordinance granting a franchise to TN Backhaul Networks, LLC, to construct, operate, and maintain a telecommunications system within Metropolitan Nashville and Davidson County under the provisions of Metropolitan Code of Laws, Title 6, Chapter 26 (Proposal No. 2016M-001FR-001). The bill was approved by the Planning Commission. The Budget and Finance, Planning, Zoning, and Historical, and Public Works Committees approved the bill with two amendments. The Planning, Zoning, and Historical Committee also recommended a re-referral to its Committee. Mr. Pridemore offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. Mr. Pridemore offered Amendment No. 2 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. Mr. Pridemore moved to pass the bill on second reading as amended and re-refer the bill to the Planning, Zoning, and Historical Committee, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-375

An ordinance to amend Chapter 6.28 of the Metropolitan Code pertaining to the maximum occupancy of Short Term Rental Property. The Codes, Fair, and Farmers Market and Convention, Tourism, and Public Entertainment Facilities recommended indefinite deferment at the request of the sponsor. Mr. Mendes moved to defer the bill indefinitely, which motion was seconded and approved by a voice vote of the Council with Ms. Roberts abstaining.

SUBSTITUTE BILL NO. BL2016-381

An ordinance to amend Chapter 6.28 of the Metropolitan Code pertaining to Short Term Rental Property (STRP). The Codes, Fair, and Farmers Market and Convention, Tourism, and Public Entertainment Facilities recommended deferral. Ms. Allen moved to defer the bill, which motion was seconded and approved by a voice vote of the Council with Ms. Roberts abstaining.

SUBSTITUTE BILL NO. BL2016-382

An ordinance to amend Chapter 6.28 of the Metropolitan Code pertaining to types and quantities of Short Term Rental Property. The Codes, Fair, and Farmers Market and Convention, Tourism, and Public Entertainment Facilities recommended indefinite deferment. Mr. Mendes moved to defer the bill indefinitely, which motion was seconded and approved by a voice vote of the Council with Ms. Roberts abstaining.

BILL NO. BL2016-417

An ordinance amending Section 12.40.150 of the Metropolitan Code to prohibit the display of vehicles for sale upon residential properties fronting arterial streets. Ms. Karen Johnson offered a substitute ordinance and moved that it be accepted for filing and which motion was seconded and adopted by a voice vote of the Council.

SUBSTITUTE BILL NO. BL2016-417

An ordinance amending Section 12.40.150 of the Metropolitan Code to prohibit the display of vehicles for sale upon residential properties abutting or adjacent to arterial streets. The bill was approved by the Codes, Fair, and Farmers Market Committee. Ms. Karen Johnson moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-420

An ordinance approving the First Amendment to the License and Lease Agreement between the Metropolitan Government of Nashville and Davidson County, acting by and through its Parks and Recreation Board, and Nashville Hockey Club Limited Partnership (Proposal No. 2016M-030PR-001). The bill was approved by the Planning Commission, Budget and Finance, Planning, Zoning, and Historical, and Parks, Library, and Recreation Committees. Mr. Cooper moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

An ordinance authorizing the Metropolitan Government to enter a participation agreement for the construction of public infrastructure improvements with Century Farms, LLC. An ordinance to amend the Geographic Information Systems Street and Alley Centerline Layer for the Metropolitan Government of Nashville and Davidson County by abandoning unimproved Alley Number 308 right-of-way (Proposal Number 2016M-020AB-001). Mr. Scott Davis moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-434

An ordinance readopting the Code of The Metropolitan Government of Nashville and Davidson County, Tennessee, prepared by Municipal Code Corporation including supplemental and replacement pages thereof, containing certain ordinances of a general and permanent nature enacted on or before July 6, 2016. The bill was approved by the Rules, Confirmations, and Public Elections Committee. Mr. Shulman moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-435

An ordinance amending BL2016-334, which authorized the Metropolitan Development and Housing Agency to negotiate and accept payments in lieu of ad valorem taxes from its lessees operating low income housing tax credit properties pursuant to Tennessee Code Annotated 13-20-104 and revised the program for determining qualifications and eligibility for such payments. The bill was approved by the Budget and Finance Committee. Mr. Mendes moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-308

An ordinance amending Chapter 2.149 of the Metropolitan Code to require residential rental properties receiving allocations from the Barnes Fund to include language concerning tenant conduct in the rental agreement. Mr. Hastings moved to defer the bill, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-318

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS10 to R10 zoning for property located at 2913 Simmons Avenue, at the northwest corner of Simmons Avenue and Tanksley Avenue (0.35 acres), all of which is described herein (Proposal No. 2015Z-057PR-001). Mr. Freeman offered a substitute ordinance and moved that it be accepted for filing and which motion was seconded and adopted by a voice vote of the Council.

SUBSTITUTE BILL NO. BL2016-318

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS10 to SP zoning for property located at 2913 Simmons Avenue, at the northwest corner of Simmons Avenue and Tanksley Avenue, (0.35 acres), to permit up to two residential units, all of which is described herein (Proposal No. 2016SP-091-001).
