Metropolitan Council Meeting

The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Reverend John McCullough of Woodland Presbyterian Church.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

County Medical Examiner
Appointment of Dr. Feng Li. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Planning Commission
Appointment of Ms. Brenda Diaz for a term expiring March 31, 2020. The Rules, Confirmations, and Public Elections Committee recommended deferment. Mr. Shulman moved to defer, which motion was seconded and approved by a voice vote of the Council.

Appointment of Mr. Brian Tibbs for a term expiring March 31, 2020. The Rules, Confirmations, and Public Elections Committee recommended deferment. Mr. Shulman moved to defer, which motion was seconded and approved by a voice vote of the Council.

- CONSENT AGENDA RESOLUTIONS -

RESOLUTION NO. RS2016-148

A resolution authorizing the Metropolitan Development and Housing Agency to negotiate and enter into a PILOT Agreement and accept payments in lieu of ad valorem taxes with respect to a multi-family housing project located at 930 Industrial Drive, known as Old Hickory Towers. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2016-149

A resolution calling the Metropolitan Board of Equalization (“MBOE”) into regular session beginning June 1, 2016 and special session beginning June 13, 2016. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2016-150

A resolution approving the appointment of hearing officers by the Metropolitan Board of Equalization to conduct preliminary hearing and to make investigations regarding complaints before the Board. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2016-151

A resolution accepting a Friends of Two Rivers Mansion Grant from the Friends of Two Rivers Mansion to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Parks and Recreation Department, to provide funding for two part-time employee’s salaries to provide tours at Two Rivers Mansion during the 2016 summer months and Christmas season. The resolution was approved by the Budget and Finance and Parks, Library, and Recreation Committees.

RESOLUTION NO. RS2016-152

A resolution approving Amendment One to a grant from the State of Tennessee, Department of Labor and Workforce Development, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Career Advancement Center, to establish career, training, and support services for adults (LW09F161ADULT16). The resolution was approved by the Budget and Finance and Personnel, Public Information, Human Relations, and Housing Committees.

RESOLUTION NO. RS2016-153

A resolution approving Amendment One to a grant from the State of Tennessee, Department of Human Services, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Action Commission, to provide services to assist low income and/or homeless individuals achieve self-sufficiency. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2016-154

A resolution approving Amendment Two to a contract with Vanderbilt University and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to participate as a member site in the Centers for Disease Control Tuberculosis Epidemiologic consortium studies. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2016-156

A resolution approving a grant from Adrian Budnick and community members to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to provide emergency medical care for animals at Metro Animal Control. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2016-157

A resolution accepting a grant from the U.S. Department of Health and Human Services to the Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to enhance access to a comprehensive continuum of high quality, community-based care for low income individuals and families with HIV disease. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2016-158

A resolution approving a contract by and between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, and Educare Childcare and Enrichment Center to perform activities related to the Project Diabetes Gold Sneaker Initiative Program. The resolution was approved by the Health, Hospitals, and Social Services Committee.

RESOLUTION NO. RS2016-159

A resolution amending Ordinance No. BL2016-127 to authorize the entry into an alternative license agreement for a fixed term with Greyhound Lines in addition to the other options authorized in that ordinance (Proposal No. 2016M-010PR-001). The resolution was approved by the Planning Commission, Planning, Zoning, and Historical and Public Works Committees.

RESOLUTION NO. RS2016-160

A resolution authorizing Renaissance Hotel to construct and install an aerial encroachment on the bridge over Commerce Street for the property at 611 Commerce Street (Proposal No.2016M-009EN-001). The resolution was approved by the Planning Commission, Planning, Zoning, and Historical and Public Works Committees.

RESOLUTION NO. RS2016-161

A resolution authorizing Belcourt Theatre, Inc. to construct and install an aerial encroachment at 2101 Belcourt Avenue (Proposal No.2016M-007EN-001). The resolution was approved by the Planning Commission, Planning, Zoning, and Historical and Public Works Committees.

RESOLUTION NO. RS2016-162

A resolution appropriating the amount of $12,727,200.00 from the General Fund Reserve Fund for the purchase of equipment and building repairs for various departments of The Metropolitan Government of Nashville and Davidson County. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2016-163

A resolution authorizing the Metropolitan Department of Law to compromise and settle the claim of Denise Collins against the Metropolitan Government of Nashville and Davidson County in the amount of $19,500.00, and that said amount be paid out of the Self-Insured Liability Fund. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2016-164

A resolution approving the election of certain Notaries Public for Davidson County. The resolution was approved by the Rules, Confirmations, and Public Elections Committee.

RESOLUTION NO. RS2016-165

A resolution recognizing April 8, 2016 as MEDIATION DAY in Nashville, Tennessee. The resolution was approved by the Rules, Confirmations, and Public Elections Committee.

RESOLUTION NO. RS2016-166

A resolution recognizing April 2016 as Autism Awareness Month and April 2, 2016, as World Autism Awareness Day. The resolution was approved by the Rules, Confirmations, and Public Elections Committee.

RESOLUTION NO. RS2016-167

A resolution recognizing Keep America Beautiful Great American Cleanup and designating March, April and May 2016 as “Great American Cleanup Months” in Metropolitan Nashville and Davidson County. The resolution was approved by the Rules, Confirmations, and Public Elections Committee.

RESOLUTION NO. RS2016-168

A resolution recognizing April 15, 2016, as the Gay, Lesbian, and Straight Education Network’s Day of Silence in Davidson County and across the United States. The resolution was approved by the Rules, Confirmations, and Public Elections Committee.

- RESOLUTIONS -

RESOLUTION NO. RS2015-76

A resolution requesting the Metropolitan Board of Fair Commissioners to reinstate and continue to allow gun shows on Fairgrounds property and to otherwise comply with Section 11.602 of the Metropolitan Charter. The Codes, Fair, and Farmers Market Committee recommended withdrawal. Mr. Glover moved to defer the resolution and re-refer it to the Codes, Fair, and Farmers Market Committee, which motion was seconded and adopted by a voice vote of the Council. Pursuant to Rule No. 23 the resolution is deferred indefinitely.

RESOLUTION NO. RS2016-155

A resolution approving Amendment One to a contract between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, and Family and Children’s Services 211 to provide an access to care model for the uninsured in Davidson County using the ServicePoint/CallPoint Database system. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees. RESOLUTION NO. RS2016-169

A resolution supporting House Bill 2147 / Senate Bill 2098, currently pending in the Tennessee General Assembly, which would require the principal of a school to allow a patriotic society time to recruit students to the society during school hours. Ms. Blalock offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. An ordinance amending section 2.120.100 of the Metropolitan Code pertaining to personnel for the Charter Revision Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Charter Revision Committee by a voice vote of the Council.

- BILLS ON SECOND READING -

BILL NO. BL2015-32

An ordinance amending Section 13.8.040 of the Metropolitan Code pertaining to the sale of newspapers, magazines, periodicals or other such written items to occupants of vehicles within the public right-of-way. The Public Works Committee recommended indefinite deferment at the request of the sponsor. Mr.Glover moved to defer the bill indefinitely, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-100

An ordinance amending Section 16.04.070 of the Metropolitan Code of Laws to require the director of the Metropolitan Department of Codes Administration to notify the Metropolitan Council of all building permits and applications under Section 16.28.010. The Codes, Fair, and Farmers Market Committee recommended deferment. Mr. Hagar moved to defer the bill to the second meeting in April, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-147

An ordinance amending Title 2 of the Metropolitan Code related to blighted property grant program. The bill was approved by the Budget and Finance Committee. Mr. Sledge moved to pass the bill on second reading and re-refer the bill to the Budget and Finance Committee, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-157

An ordinance amending Title 5 of the Metropolitan Code pertaining to tax increment financing. The bill was approved by the Budget and Finance Committee. Mr. Mendes moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-158

An ordinance amending Title 2 of the Metropolitan Code of Laws related to the enforcement of the Metropolitan Codes and reporting requirements. The Codes, Fair, and Farmers Market Committee recommended deferment. Mr. Shulman moved to defer the bill to the second meeting in April, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-159

An ordinance amending section 2.24.300 of the Metropolitan Code. The Budget and Finance Committee recommended deferment. Mr. Cooper moved to defer the bill to the second meeting in April, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-160

An ordinance amending Section 7.08.090 of the Metropolitan Code to exempt on-premises beer permit applicants within the urban services district from the minimum distance requirements if the establishment for which a permit is sought is separated by a state or federal highway from any church, school or playground, park, licensed day care center or nursery school or playgrounds, or dwelling for one or two families. The bill was approved by the Public Safety, Beer, and Regulated Beverages Committee. Mr. Sledge offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. Mr. Sledge moved to pass the bill on second reading as amended, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-161

An ordinance requiring the Metropolitan Board of Fair Commissioners to refrain from scheduling events or activities scheduled on or after January 1, 2017 until such time as a court of law or the Tennessee Attorney General determines whether the Board is in violation of the Metropolitan Charter or state or federal legislation. The Codes, Fair, and Farmers Market Committee recommended indefinite deferment. Pursuant to Rule No. 24, the bill is indefinitely deferred.

BILL NO. BL2016-162

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon an existing unused sanitary sewer easement located at 1176 Stones River Road, recorded via Instrument No. 20100720005652 RODC, TN (Proposal No. 2016M-006ES-001). The bill was approved by the Planning Commission, Planning, Zoning, and Historical and Public Works Committees. Mr. Rhoten moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-163

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon an existing sewer main and easement and to accept new sewer mains, manholes, new water mains and fire hydrants, and to negotiate and accept temporary and permanent easements for property located at 1414 Rosebank Avenue (MWS Project Nos. 15-SL-1 and 15-WL-1 and Proposal No. 2015M-059ES-001). The bill was approved by the Planning Commission, Planning, Zoning, and Historical and Public Works Committees. Mr. Anthony Davis moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.
