RESOLUTION NO. RS2016-169

A resolution supporting House Bill 2147 / Senate Bill 2098, currently pending in the Tennessee General Assembly, which would require the principal of a school to allow a patriotic society time to recruit students to the society during school hours.

WHEREAS, Tennessee Code Annotated § 49-6-301, et seq. defines and regulates elementary and middle schools in Tennessee; and

WHEREAS, Representative Rick Womick and Senator Bill Ketron are the sponsors of House Bill 2474 / Senate Bill 2098, currently pending in the Tennessee General Assembly, that would require the principal of a school to allow a patriotic society time to speak with and recruit students to the society during school hours; and

WHEREAS, HB2474 / SB2098 defines "patriotic society" as a group or organization listed in title 36 of the United States Code that is a youth membership organization with an educational purpose that aligns with the curriculum standards and promotes civic involvement. Such groups would include the Girl Scouts of America, among others; and

WHEREAS, HB2474 / SB 2098 specifies that a school give the patriotic society one (1) day at the beginning of each academic year for the society to speak for no more than ten (10) minutes; and

WHEREAS, HB2474 / SB 2098 specifies that the patriotic society shall provide verbal or written notice to the principal of the society’s intent to speak to the students, and the principal shall in turn provide verbal or written approval of the specific day and time for the society to address the students; and

WHEREAS, the Metropolitan Council is in support of HB 2474 / SB 2098 since it would enable such patriotic societies to recruit elementary and middle school students during school hours to worthwhile causes, activities, and organizations.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Metropolitan County Council hereby goes on record as supporting House Bill 2474 / Senate Bill 2098, currently pending in the Tennessee General Assembly, which would require the principal of a school to allow a patriotic society time to speak with and recruit students to the society during school hours.

Section 2. The Metropolitan Clerk is directed to send a certified copy of this Resolution to each member of the Davidson County Delegation to the Tennessee General Assembly.

Section 3. This Resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Mr. President –

I move to amend Resolution No. RS2016-169 as follows:

I. By deleting all references to “House Bill 2474” and to “HB 2474”, substituting therefore “House Bill 2147” and “HB 2147” respectively.
