Metropolitan Council Meeting

The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Bishop Alvin E. Miller, Sr. of St. John Missionary Baptist Church, Clarksville, TN.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The Minutes of the regular meeting of January 19, 2016 were approved.

Vice Mayor Briley acknowledged receipt of the resignation of Councilman Lionel Greene and his letter of resignation was made part of the record.

Dear Vice Mayor Briley,

I write to resign my position as elected Councilman for District 1. When I ran for this office, I did so with the goals of unifying the diverse communities of the district, encouraging growth that preserved its unique character, and promoting economic development that benefited all its residents. Today, I do not believe I can promote these goals effectively.

In my short time on the Council, I have come to respect its members greatly, and I am confident to make our city better. As these efforts continue, the people of Nashville deserve a Council that can operate without distraction. Unfortunately, I have become a distraction, and I believe District 1 will be better served if I step aside to allow others to serve.

Thank you again for the privilege of working with you.

Vice Mayor Briley announced that At Large Councilmember Sharon Hurt would handle District 1 matters until a replacement representative can be elected.

Vice Mayor Briley noted correspondence and related reports distributed to Council Members from the Director of Finance on behalf of the Tennessee State Comptroller’s Office regarding RS2016-101. He acknowledged the parties available for questions and discussion during this item.

- ELECTIONS AND CONFIRMATIONS -

Metropolitan Development and Housing Agency
Appointment of Mr. Charles Robert Bone for a term expiring November 5, 2019. Mr. Bone will fill the unexpired term of Ms. Anna Page. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Nashville Education, Community and Arts Television Corporation (NECAT)
Reappointment of Mr. Michael Hart for a term expiring February 5, 2019. The Rules, Confirmations, and Public Elections Committee recommended the reappointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Mr. John Lasiter for a term expiring February 5, 2019. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Ms. Gisela Moore for a term expiring February 5, 2019. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Ms. Aqiyla Reed for a term expiring February 5, 2017. Mr. Bone will fill the unexpired term of Mr. J. BILL NO. BL2015-86

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R15 and R20 to SP for properties located at 326 Old Hickory Boulevard, Old Hickory Boulevard (unnumbered) and Highway 70 (unnumbered), on the east side of Old Hickory Boulevard and north of Highway 70 (approximately 246 acres), to permit the additional disturbance of the natural landscape to a maximum of 14 acres to permit up to 360 multi-family residential units, all of which is described herein (Proposal No. 2015SP-113-001). The bill was approved by the Planning Commission with conditions, disapproved without including amendment.

BILL NO. BL2015-87

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by canceling a portion of the Nashville Highlands Planned Unit Development Overlay District for properties located at 326 Old Hickory Boulevard, Old Hickory Boulevard (unnumbered) and Highway 70 (unnumbered), on the east side of Old Hickory Boulevard and north of Highway 70 (approximately 246 acres), zoned R15 and R20, all of which is described herein (Proposal No. 73-85P-001). The bill was approved by the Planning Commission with conditions, disapproved without including amendment.

BILL NO. BL2015-96

An ordinance amending Section 17.04.060 and 17.08.030 of the Metropolitan Zoning Code by modifying the definition of “Historic home event” to limit events to enclosed areas (Proposal No. 2016Z-002TX-001). The bill was disapproved by the Planning Commission. Mr. Withers moved to withdraw the bill, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2015-97

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from IR to MUL-A zoning for property located at 2611 Clifton Avenue, at the southeast corner of Clifton Avenue and 27th Avenue North (0.21 acres), all of which is described herein (Proposal No. 2015Z-084PR-001). The bill was approved by the Planning Commission. Mr. Kindall requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS5 to SP zoning for properties located at 3005 Delaware Avenue and 508 31st Avenue North, at the southeast corner of 31st Avenue North and Delaware Avenue (0.69 acres), to permit up to 17 residential units, all of which is described herein (Proposal No. 2015SP-094-001). The bill was approved by the Planning Commission, with conditions, disapproved without. Mr. Kindall requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and a citizen was heard in opposition to passage of the bill. The President declared the public hearing closed. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by making applicable the provisions of the Inglewood Place Neighborhood Conservation Overlay District to various properties located along Golf Street, Greenfield Avenue, Howard Avenue, Inglewood Circle North, Inglewood Circle South, Jakes Avenue, Katherine Street, Kennedy Avenue, Kirkland Avenue, McChesney Avenue, Oxford Street, Riverside Drive, Shelton Avenue, and Stratford Avenue (163.75 acres), all of which is described herein (Proposal No. 2016NHC-001-001).
The bill was approved by the Planning Commission with an amendment. Mr. Davis moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-108

- CONSENT AGENDA RESOLUTIONS -

RESOLUTION NO. RS2016-103

A resolution accepting a grant from the National Endowment for the Arts, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Arts Commission in conjunction with the Arts & Business Council of Greater Nashville, to create an artist learning lab for community based training programs for artists in civic, public, social, and place making artistic practices. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2016-104

A resolution accepting a grant from the Inglewood Neighborhood Association to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Parks and Recreation, to supplement funding for carpet replacement at the Shelby Golf Course Clubhouse. The resolution was approved by the Budget and Finance and Parks, Library, and Recreation Committees.

RESOLUTION NO. RS2016-105

A resolution approving an application for a Big Band Dances Grant from the State of Tennessee, Tennessee Arts Commission, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Parks and Recreation Department. The resolution was approved by the Budget and Finance and Parks, Library, and Recreation Committees.

RESOLUTION NO. RS2016-106

A resolution accepting a package of grants from the Friends of Warner Parks to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Parks and Recreation, to provide staffing for Warner Parks Center, Nature Center support, and the SWEAT Program for additional labor for summer maintenance. The resolution was approved by the Budget and Finance and Parks, Library, and Recreation Committees.

RESOLUTION NO. RS2016-107

A resolution approving Amendment One to a grant from the State of Tennessee, Department of Labor and Workforce Development, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Career Advancement Center, to provide reemployment services and eligibility assessment services to help unemployment insurance claimants to return to work faster (LW09F151RESEA16). The resolution was approved by the Budget and Finance and Personnel, Public Information, Human Relations, and Housing Committees.

RESOLUTION NO. RS2016-108

A resolution approving an agreement between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, and The Centers for Medicare & Medicaid Services (CMS) to facilitate the operation of Federally-facilitated Exchanges (FFEs) between (CMS) and the Metropolitan Board of Health as a Certified Application Counselor Organization. The resolution was approved by the Health, Hospitals, and Social Services Committee.

RESOLUTION NO. RS2016-109

A resolution authorizing the Metropolitan Department of Law to compromise and settle the claim of Genaro Navarro Pascual against the Metropolitan Government of Nashville and Davidson County in the amount of $200,000.00, and that said amount be paid out of the Self-Insured Liability Fund. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2016-110

A resolution authorizing Three Crow Bar to construct and install an aerial encroachment at 1024 Woodland Street (Proposal No.2015M-028EN-001). The resolution was approved by the Planning Commission, Planning, Zoning, and Historical and Public Works Committees.

RESOLUTION NO. RS2016-111

A resolution authorizing Legends Gifts to construct and install an aerial encroachment at 325 Broadway (Proposal No.2016M-002EN-001). The resolution was approved by the Planning Commission, Planning, Zoning, and Historical and Public Works Committees.

RESOLUTION NO. RS2016-112

A resolution authorizing 401 Union Hotel, LLC to construct and install an aerial encroachment at 401 Union Street ( Proposal No.2016M-001EN-001). The resolution was approved by the Planning Commission, Planning, Zoning, and Historical and Public Works Committees.

RESOLUTION NO. RS2016-114

A resolution recognizing February 15 through February 19, 2016, as Show Your Love for Teachers Week in Metropolitan Nashville/Davidson County.

- RESOLUTIONS -

RESOLUTION NO. RS2016-86

A resolution authorizing the Metropolitan Development and Housing Agency to negotiate and enter into a PILOT Agreement and accept payments in lieu of ad valorem taxes with respect to a multi-family housing project located at 5515 Scruggs Lane, also known as 230 West Trinity Lane, to be known as the Paddock at Grandview. Mr. Hastings requested a suspension of the rules to allow a revised agreement and no objection was made. Mr. Hastings offered a substitute resolution and moved that it be accepted for filing and which motion was seconded and adopted by a voice vote of the Council.

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing sewer main and to accept new sewer main and easement for four properties located along Franklin Pike (MWS Project No. 15-SL-207 and Proposal No. 2015M-058ES-001). The bill was approved by the Planning Commission, Planning, Zoning, and Historical and Public Works Committees. Mr. Sledge moved to pass the bill on third reading, which motion was seconded and adopted by the following vote: “Ayes” Cooper, Gilmore, Mendes, Hurt, Shulman, Haywood, Swope, Scott Davis, Withers, Anthony Davis, VanReece, Pardue, Pridemore, Pardue, Hagar, Glover, Huezo, Rhoten, Syracuse, Freeman, Sledge, Allen, O’Connell, Roberts, Weiner, Mina Johnson, Murphy, Pulley, Elrod, Blalock, Vercher, Karen Johnson, Potts, Bedne, Dowell, Coleman, Henderson, Rosenberg (38); “Noes” (0).
