ORDINANCE NO. BL2016-118

An ordinance to amend Chapter 6.28 of the Metropolitan Code pertaining to Short Term Rental Property.

WHEREAS, Ordinance No. BL2015-94 was recently filed and considered by the Metropolitan County Council for purposes of, inter alia, revising the definition of “owner-occupied” under Section 6.28.030 B of the Metropolitan Code of Laws; and

WHEREAS, the revised definition could have unintended consequences and therefore requires further community engagement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That paragraph 6.28.030 B. be revised by deleting it in its entirety and substituting the following text:

“For purposes of this section, "owner-occupied" means the owner of the property
permanently resides in the STRP or in the principal residential unit with which
the STRP is associated on the same lot."

Section 2. That this Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
