ORDINANCE NO. BL2016-103

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing sewer main and to accept new sewer main and easement for four properties located along Franklin Pike (MWS Project No. 15-SL-207 and Proposal No. 2015M-058ES-001).

WHEREAS, the abandonment of approximately 80 linear feet of existing 10 inch sewer main and 537 linear feet of existing 36 inch sewer main and the acceptance of approximately 80 linear feet of new 10 inch sewer main and 537 linear feet of new 36 inch sewer main and easements, along with six new manhole assemblies, for properties located at 2600, 2608, 2610, and 2612 Franklin Pike, are needed to construct project number 15-SL-207; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2015M- 058ES-001 on November 18, 2015 for the abandonment and acceptance of said sewer main and easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 80 linear feet of existing 10 inch sewer main and 537 linear feet of existing 36 inch sewer main and to accept approximately 80 linear feet of new 10 inch sewer main and 537 linear feet of new 36 inch sewer main and easements, along with six new manhole assemblies for properties located at 2600, 2608, 2610, and 2612 Franklin Pike, as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
