ORDINANCE NO. BL2016-119

An ordinance approving an agreement granting CCA of Tennessee, LLC access to the 800-MHZ system for public safety purposes.

WHEREAS, The Metropolitan Government of Nashville and Davidson County ("Metropolitan Government") and the Electric Power Board of The Metropolitan Government of Nashville and Davidson County ("NES") jointly own and operate an emergency radio dispatch and response system (“System”), utilizing 800-MHZ radio frequencies licensed by the Federal Communications Commission; and,

WHEREAS, CCA of Tennessee, LLC (“CCA”) has entered into Contract Number 355078 with the Metropolitan Government to provide Correctional Facility Management Services for the Davidson County Sheriff’s Office; and,

WHEREAS, the duties of CCA include supporting the Metropolitan Government in providing and promoting public safety via CCA’s management and operation of the Metropolitan Detention Facility; and,

WHEREAS, CCA has requested to be granted interoperability with the System; and,

WHEREAS, access to the System would enhance CCA’s ability to discharge its contractual duties to the Metropolitan Government and would also benefit the Metropolitan Government’s efforts to provide public safety; and,

WHEREAS, the Metropolitan Government, NES and CCA have agreed upon the terms of an agreement to allow CCA access to the 800-MHZ System.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Agreement by and between The Metropolitan Government of Nashville and Davidson County, the Electric Power Board of The Metropolitan Government of Nashville and Davidson County, and CCA of Tennessee, LLC, for access to the 800-MHZ System, attached hereto and incorporated herein, is hereby approved and the Metropolitan Mayor is authorized to execute said Agreement.

Section 2. That any new amendments to the Agreement between The Metropolitan Government of Nashville and Davidson County, the Electric Power Board of The Metropolitan Government of Nashville and Davidson County, and CCA of Tennessee, LLC, may be approved by resolution of the Metropolitan Council receiving at least twenty-one (21) affirmative votes.

Section 3. That this Ordinance shall take effect from and after its final passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
