Metropolitan Council Meeting

The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Councilman Walter Hunt.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The roll was called and the following members were present during the progress of the meeting: Barry, Steine, Garrett, Tygard, Maynard, Matthews, Harrison, Hunt, Scott Davis, Westerholm, Anthony Davis, Bennett, Pridemore, Pardue, Hagar, Glover, Stites, Stanley, Claiborne, Tenpenny, Moore, Allen, Gilmore, Baker, Langster, Weiner, Evans, Holleman, McGuire, Harmon, Blalock, Dominy, Johnson, Potts, Bedne, Dowell, Duvall, Todd, Mitchell and Neighbors (40); Absent: Banks (1).

The Minutes of the regular meeting of May 19, 2015 were approved.

Mr. Harmon moved that at the time of adjournment, the Council adjourn to Tuesday, June 9, 2015, at 6:00 p.m. for the purpose of considering Ordinance No. BL2015-1142, the Capital Improvements Budget for fiscal year 2016, on third and final reading along with any other matters the Vice Mayor deems appropriate for consideration at that time.

- ELECTIONS AND CONFIRMATIONS -

Historic Zoning Commission
Reappointment of Mr. Ben Mosley for a term expiring June 1, 2020. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Harmon moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Human Relations Commission
Appointment of Dr. Erin Pryor for a term expiring April 18, 2018. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Harmon moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

- BILLS ON PUBLIC HEARING AND SECOND READING -

BILL NO. BL2015-1122

A bill to be entitled: The Budget Ordinance of the Metropolitan Government of Nashville and Davidson County, Tennessee for Fiscal Year 2016. The bill was approved by the Budget and Finance Committee. Mr. Pridemore requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in favor of passage of the bill. The President declared the public hearing closed. Mr. Pridemore moved to pass the bill on second reading and re-refer the bill to the Budget and Finance Committee, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2015-1142

An ordinance adopting the Capital Improvements Budget and Program 2015-2016 through 2020-2021 for The Metropolitan Government of Nashville and Davidson County as the official Capital Improvements Budget and Program of The Metropolitan Government of Nashville and Davidson County for Fiscal Year 2015-2016. The bill was approved by the Planning Commission, the Budget and Finance and Planning, Zoning and Historical Committees. Mr. Pridemore requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in favor of and in opposition to passage of the bill. Documents were filed for the record. The President declared the public hearing closed. Mr. Pridemore moved to pass the bill on second reading and re-refer the bill to the Budget and Finance and Planning, Zoning and Historical Committees, which motion was seconded. After discussion, Mr. Todd called for the previous question, which motion was seconded and adopted by a voice vote of the Council. - CONSENT AGENDA RESOLUTIONS -

RESOLUTION NO. RS2015-1502

A resolution approving a contract between the State of Tennessee, Department of Mental Health and Substance Abuse Services, and The Metropolitan Government of Nashville and Davidson County for establishing agreed rates for court ordered evaluations and treatment for defendants charged with misdemeanor crimes. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2015-1503

A resolution accepting a grant from the State of Tennessee, Department of Children’s Services, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Davidson County Juvenile Court, to provide staffing support for at-risk youth utilizing a validated, research informed mental health screening and/or assessment tool to identify potential mental health problems. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2015-1504

A resolution accepting a Friends of Two Rivers Mansion Grant from the Friends of Two Rivers Mansion to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Parks and Recreation Department, to provide partial funding for one employee’s salary. The resolution was approved by the Budget and Finance and Parks, Library and Recreation Committees.

RESOLUTION NO. RS2015-1505

A resolution accepting a donation from the Nashville Public Library Foundation to The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Public Library. The resolution was approved by the Budget and Finance and Parks, Library and Recreation Committees.

RESOLUTION NO. RS2015-1506

A resolution accepting and appropriating a donation of $10,018.00 from the 10th Avenue Multifamily Partners LLC to the Metropolitan Government of Nashville and Davidson County for the use and benefit of the Metropolitan Social Services Commission in the transition of residents at the James Robertson Apartments. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2015-1508

A resolution approving Amendment Five to a contract between Opus Inspection, Inc. and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health for services relating to automobile emission testing. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2015-1509

A resolution approving a contract between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, and Availity to use a secure web site to submit transactions for medical services provided to health plans. The resolution was approved by the Health, Hospitals and Social Services Committee.

RESOLUTION NO. RS2015-1510

A resolution approving Amendment One to a grant from the State of Tennessee, Department of Environment and Conservation, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Public Works Department, for the operation and maintenance of a household hazardous waste collection site. The resolution was approved by the Budget and Finance and Public Works Committees.

RESOLUTION NO. RS2015-1511

A resolution approving the final license agreement to use Metropolitan Government property for Network Huts by Google Fiber company previously approved by BL2014-744, approving the specific properties agreed to by the parties’ as proposed Network Hut locations and approving the completed exhibits setting forth the specific terms applicable to Google Fiber’s use of each property proposed as a Network Hut location (Proposal No. 2014M-010PR-002). The resolution was approved by the Planning Commission, Budget and Finance, Public Works and Planning, Zoning and Historical Committees.

RESOLUTION NO. RS2015-1512

A resolution authorizing the Mayor to employ the law firm of Lieff Cabraser Heimann & Bernstein, LLP, as special counsel, on a contingent fee basis, to investigate and pursue claims against pharmaceutical manufacturing companies that have illegally suppressed lower priced generic competition or engaged in other illegal conduct that has caused economic harm to the Metropolitan Government. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2015-1513

A resolution recognizing Mr. Mark A. Cleveland on being honored with the 2014 NEXT Award as Entrepreneur of the Year. The resolution was approved by the Rules-Confirmations-Public Elections Committee.

RESOLUTION NO. RS2015-1514

A resolution honoring Father Philip M. Breen on his Golden Jubilee and Retirement. The resolution was approved by the Rules-Confirmations-Public Elections Committee.

RESOLUTION NO. RS2015-1499

Resolution authorizing the issuance, sale and payment of general obligation improvement bonds in an aggregate principal amount of not to exceed $400,000,000; and providing for the levy of taxes for the payment of debt service on the bonds. The Budget and Finance Committee recommended deferral. Mr. Pridemore moved to defer the resolution, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2015-1500

Initial resolution determining to issue general obligation bonds of The Metropolitan Government of Nashville and Davidson County in an aggregate principal amount of not to exceed Five Hundred Twenty Million Dollars. The Budget and Finance Committee recommended deferral. Mr. Pridemore moved to defer the resolution, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2015-1501

A resolution authorizing an economic and community development incentive grant to be made to the Industrial Development Board of the Metropolitan Government of Nashville and Davidson County for the benefit of Asurion, LLC. The resolution was approved by the Budget and Finance Committee with an amendment. Mr. Pridemore offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. RESOLUTION NO. RS2015-1507

A resolution approving a memorandum of understanding between the Tennessee Department of Health and the Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health for long-acting reversible contraception pharmaceuticals for use in the family planning program. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees. RESOLUTION NO. RS2015-1498

A resolution requesting the Metropolitan Civil Service Commission to consider and recommend an amendment to the General Pay Plan to partially base the compensation of Members of the Metropolitan Council upon Council and committee meeting attendance. The Personnel-Public Information-Human Relations-Housing Committee disapproved the resolution. Mr. Tygard moved to defer the resolution, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2015-1515

A resolution requesting the Davidson County Delegation to the Tennessee General Assembly to introduce and support the necessary legislation to require full-time Davidson County elected officials to submit an annual report to the Comptroller detailing the dates they worked. The Rules-Confirmations-Public Elections Committee recommended deferment. Mr. Tygard moved to defer the resolution, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2015-1516

A resolution requesting the Davidson County Delegation to the Tennessee General Assembly to introduce and support an amendment to T.C.A. § 66-35-102 to allow the Metropolitan Government to enact inclusionary zoning legislation to ensure sufficient affordable rental housing units are available in Davidson County. The resolution was approved by the Rules-Confirmations-Public Elections Committee. An ordinance authorizing The Industrial Development Board of The Metropolitan Government of Nashville and Davidson County to negotiate and accept payments in lieu of ad valorem taxes with respect to CHS Realty Holdings III, LLC. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance Committee by a voice vote of the Council.

BILL NO. BL2015-1144

An ordinance amending Chapter 6.28 of the Metropolitan Code to allow lessees to operate a Short Term Rental Property with permission of the property owner. Upon motion duly seconded, the bill passed first reading and was referred to the Codes, Fair and Farmers Market and Convention, Tourism & Public Entertainment Facilities Committees by a voice vote of the Council.

BILL NO. BL2015-1145

An ordinance amending Chapters 10 and 16 of the Metropolitan Code of Laws to adopt updated fire, building, dwelling, energy, gas/mechanical, and plumbing codes with amendments. Upon motion duly seconded, the bill passed first reading and was referred to the Codes, Fair and Farmers Market Committee by a voice vote of the Council.

BILL NO. BL2015-1146

An ordinance amending Chapter 12.44 of the Metropolitan Code to provide for annually-paid parking for free-floating car-sharing organization vehicles in parking meter zones and amending Section 12.42.070 of the Metropolitan Code to allow free-floating car-sharing vehicles to be exempt from the limitations imposed on vehicles lacking a residential parking permit when parking in a residential parking permit area. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance, Public Works and Traffic, Parking and Transportation Committees by a voice vote of the Council.

BILL NO. BL2015-1147

An ordinance requiring the Metropolitan Planning Department to prepare an amendment to the Metropolitan Zoning Code to require affordable and workforce housing units as part of residential developments, and to establish rules and regulations pertaining to the implementation of such requirements. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning and Historical Committee.

BILL NO. BL2015-1148

An ordinance to amend the Geographic Information Systems Street and Alley Centerline Layer for the Metropolitan Government of Nashville and Davidson County by abandoning a portion of Redmon Street right-of-way (Proposal No. 2015M-005AB-001). The bill was approved by the Planning Commission and Traffic and Parking Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Public Works, Traffic, Parking and Transportation and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2015-1149

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 1,240 linear feet of sewer main and easement and to accept a new manhole and 30 linear feet of 12 inch DIP sewer main for various properties located along George L Davis Boulevard, 12th Avenue North, and Church Street (MWS Project No. 15-SL-11 and Proposal No. 2015M-026ES-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Public Works and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2015-1150

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 126 linear feet of an eight inch sanitary sewer main and easement for property located at Elliott Avenue (unnumbered), (MWS Project No.15-SL-42 and Proposal No. 2015M-025ES-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Public Works and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2015-1151

An ordinance authorizng the Metropolitan Nashville Police Department to donate certain vests to the Armor of God Project, Inc., for refurbishment and distribution of the vests to under-funded law enforcement entities around the country and world. Upon motion duly seconded, the bill passed first reading and was referred to the Public Safety-Beer and Regulated Beverages Committee by a voice vote of the Council.

BILL NO. BL2015-1152

An ordinance amending Chapters 17.12 of the Metropolitan Code to update the Downtown Code (DTC) standards (Proposal No. 2015Z-003TX-002). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission and Planning, Zoning and Historical Committee by a voice vote of the Council.

BILL NO. BL2015-1153

An ordinance to amend various sections of Title 17 of the Metropolitan Zoning Code to add alternative zoning districts and modify alternative zoning district standards (Proposal No. 2015Z-012TX-001). BILL NO. BL2015-1154

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from IG to MUI-A zoning for properties located at 700, 740, 750, 800, 815, 901, 905 Cowan Street and 1420 and 1432 Cowan Court, approximately 2,000 feet north of Jefferson Street (59.13 acres), all of which is described herein (Proposal No. 2015Z-018PR-001). The bill was approved by the Planning Commission. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R6 to SP zoning for properties located at 1114 and 1116 2nd Avenue South, approximately 205 feet north of Chestnut Street (0.29 acres), to permit up to four residential units, all of which is described herein (Proposal No. 2015SP-045-001). Mr. Todd requested a suspension of the rules to allow the bill to be heard and no objection was made. Mr. Todd moved to pass the bill on first reading and refer the bill to the Planning Commission and Planning, Zoning and Historical Committee, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2015-1208

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from ON to RM20-A zoning for property located at 1208 Hawkins Street, approximately 200 feet west of 12th Avenue South (0.25 acres), all of which is described herein (Proposal No. 2015Z-032PR-001).
The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning and Historical by a voice vote of the Council.

Without objection, the rules were suspended for consideration of one (1) late ordinance.

BILL NO. BL2015-1209

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a and R10 to SP zoning for properties located at County Hospital Road (unnumbered) and 1016 Camilla Caldwell Lane and Camilla Caldwell Lane (unnumbered) and a portion of property located at 1010 Camilla Caldwell Lane, located west of the intersection of County Hospital Road and Hospital Lane, (525.5 acres), to permit a mixed use development, all of which is described herein (Proposal No. 2015SP 060-001). Mr. Matthews moved to pass the bill on first reading and refer the bill to the Planning Commission and Planning, Zoning and Historical Committee, which motion was seconded and adopted by a voice vote of the Council.

An ordinance approving three agreements between the Metropolitan Government and the Electric Power Board of the Metropolitan Government (collectively, the “System Owners”) and (1) the United States Marshals Service (USMS), (2) Belmont University, and (3) Smyrna/Rutherford County Airport Authority (SRCAA) for access to 800-MHZ for emergency radio dispatching and response.

An ordinance approving a Relocation Agreement providing for Metropolitan Government departments having equipment attached to space provided on poles as permitted by third parties to relocate that equipment as needed to accommodate Google Fiber’s construction or placement of its fiber optic cables in space provided on poles as permitted by third parties, at Google Fiber’s expense, or allowing Google Fiber to relocate such equipment itself at its own expense (Proposal No. 2015M-012PR-001).
