RESOLUTION NO. RS2015-1502

A resolution approving a contract between the State of Tennessee, Department of Mental Health and Substance Abuse Services, and The Metropolitan Government of Nashville and Davidson County for establishing agreed rates for court ordered evaluations and treatment for defendants charged with misdemeanor crimes.

WHEREAS, T.C.A. Title 33, Chapter 7, Part 3 authorizes general sessions judges to order a defendant charged with a misdemeanor crime to undergo outpatient or inpatient mental health evaluations and treatment; and,

WHEREAS, The Metropolitan Government is responsible for the payment of the direct costs of such evaluations and treatment conducted at the State’s Regional Mental Health Institutes; and,

WHEREAS, the attached agreement and amendment establishes reduced rates for the cost of the evaluations and treatment ordered by the court; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this contract be approved.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: That the contract and its amendment, by and between the State of Tennessee, Department of Mental Health and Substance Abuse Services, and the Metropolitan Government of Nashville and Davidson County, establishing reduced rates for the evaluations and treatment of defendants charged with misdemeanors, a copy of which is attached hereto and incorporated herein, is hereby approved.

Section 2: That this resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
