ORDINANCE NO. BL2015-1130

An ordinance approving three agreements between the Metropolitan Government and the Electric Power Board of the Metropolitan Government (collectively, the “System Owners”) and (1) the United States Marshals Service (USMS), (2) Belmont University, and (3) Smyrna/Rutherford County Airport Authority (SRCAA) for access to 800-MHZ for emergency radio dispatching and response.

WHEREAS, the System Owners jointly own and operate an emergency radio dispatch and response system (the “System”) utilizing 800-MHZ radio frequencies licensed by the Federal Communications Commission ("F.C.C."); and,

WHEREAS, USMS, Belmont University, and SRCAA wish to have access to the System for use in the performance of public safety functions; and,

WHEREAS, pursuant to the terms of the three agreements attached and incorporated into this ordinance as Exhibits 1, 2, and 3, the System Owners propose to grant access to the System to USMS, Belmont University, and SRCAA; and,

WHEREAS, it is in the best interest of the citizens of Nashville and Davidson County to approve the agreements described herein.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The agreement by and between the System Owners and the USMS for access to the System is approved and its execution by the Metropolitan Mayor is authorized.

Section 2. The agreement by and between the System Owners and Belmont University for access to the System is approved and its execution by the Metropolitan Mayor is authorized.

Section 3. The agreement by and between the System Owners and SRCAA for access to the System is approved and its execution by the Metropolitan Mayor is authorized.

Section 4. This ordinance shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
