Metropolitan Council Meeting

The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Councilman Jerry Maynard.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The Minutes of the regular meeting of April 7, 2015 were approved.

- ELECTIONS AND CONFIRMATIONS –

Auditorium Commission
Appointment of Ms. Christy Watkins for a term expiring June 30, 2015. Ms. Watkins will fill the unexpired term of Ms. Kay Clary. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Harmon moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

CATV Special Committee
Appointment of Mr. Ty Draper for a term expiring March 1, 2018. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Harmon moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Civil Service Commission
Reappointment of Ms. Jo Ann North for a term expiring March 31, 2020. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Harmon moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Board of Fair Commissioners
Reappointment of Mr. Ned Horton for a term expiring April 6, 2020. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Harmon moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Human Relations Commission
Appointment of Mr. Oscar Miller for a term expiring April 18. 2018. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Harmon moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Ms. Janice Rodriquez for a term expiring April 18. 2018. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Harmon moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

- CONSENT AGENDA RESOLUTIONS –

RESOLUTION NO. RS2015-1445

A resolution authorizing the Metropolitan Mayor to submit the 2015-2016 Annual Update to the 2013-2018 Consolidated Plan for Housing and Community Development to the U.S. Department of Housing and Urban Development. The resolution was approved by the Budget and Finance and Federal Grants Review Committees.

RESOLUTION NO. RS2015-1446

A resolution accepting a grant from the State of Tennessee, Tennessee Arts Commission, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Arts Commission, for funding to non-profit organizations to conduct community arts projects in Davidson County. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2015-1447

A resolution approving an application for a grant from the State of Tennessee, Department of Finance and Administration, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Office of the District Attorney General, to work with Hispanic victims of crimes, child homicide families, and child sexual and physical abuse victims who find the criminal justice system disorienting due to their language limitations and cultural understanding. The resolution was approved by the Budget and Finance and Public Safety-Beer and Regulated Beverages Committees.

RESOLUTION NO. RS2015-1448

A resolution approving a grant application for a grant from the U. S. Department of Justice to The Metropolitan Government of Nashville and Davidson County, acting by and through the Mayor’s Office, to encourage arrest policies and the enforcement of protection orders to keep victims of domestic violence safe and hold offenders accountable, to assess and respond to victim risk, to increase civil/legal advocacy at Order of Protection hearings, and to meet training needs. The resolution was approved by the Budget and Finance and Public Safety-Beer and Regulated Beverages Committees.

RESOLUTION NO. RS2015-1449

A resolution approving an application for a grant from the State of Tennessee, Department of Finance and Administration, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Police Department, to provide mental health services and criminal justice system advocacy whenever individuals, families, and/or the community are affected by violent crime. The resolution was approved by the Budget and Finance and Public Safety-Beer and Regulated Beverages Committees.

RESOLUTION NO. RS2015-1450

A resolution accepting a grant from the State of Tennessee, Department of Finance and Administration, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Police Department, for the Internet Crimes Against Children Unit. The resolution was approved by the Budget and Finance and Public Safety-Beer and Regulated Beverages Committees.

RESOLUTION NO. RS2015-1451

A resolution accepting a grant from the Tennessee State Library and Archives to The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Public Library, for the acquisition of services, supplies, devices, and furnishings to house, keep, preserve, and make available permanently valuable records held by institutions within the State of Tennessee. The resolution was approved by the Budget and Finance and Parks, Library and Recreation Committees.

RESOLUTION NO. RS2015-1452

A resolution accepting a grant from the State of Tennessee, Tennessee State Library and Archives, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Parks Department, to preserve, catalogue, and make available to the public a collection of research pertaining to the Civil War in Middle Tennessee at the Fort Negley Park and Visitors Center. The resolution was approved by the Budget and Finance and Parks, Library and Recreation Committees.

RESOLUTION NO. RS2015-1453

A resolution accepting a grant from the Metropolitan Development and Housing Agency to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Historical Commission, to perform Section 106 environmental review necessary for development proposals using federal funds to determine potentially adverse effects to historic properties. The resolution was approved by the Budget and Finance and Planning, Zoning and Historical Committees.

RESOLUTION NO. RS2015-1454

A resolution approving a grant application for a grant from the Greater Nashville Regional Council to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Social Services Commission, to deliver meals that meet RDA nutritional guidelines to eligible seniors throughout Davidson County under the options program. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2015-1455

A resolution approving a grant application for a grant from the Greater Nashville Regional Council to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Social Services Commission, to provide meals that meet RDA nutritional guidelines at congregate meal sites and meal delivery services to eligible seniors. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2015-1456

A resolution approving a grant application for a grant from the Greater Nashville Regional Council to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Social Services Commission, to provide transportation to eligible seniors and handicapped residents in Davidson County. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2015-1457

A resolution approving Amendment One to a grant from the State of Tennessee, Department of Labor and Workforce Development, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Career Advancement Center, to establish programs and deliver services to prepare eligible participants for re-entry into the labor force and to offer training to those facing serious barriers to productive employment (LW09F151DSLWK15). RESOLUTION NO. RS2015-1458

A resolution approving Amendment One to a grant from the State of Tennessee, Department of Labor and Workforce Development, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Career Advancement Center, to provide activities that increase the employment, retention, and earnings of participants (LW09P131NCSWA14). RESOLUTION NO. RS2015-1459

A resolution approving Amendment One to a grant from the State of Tennessee, Department of Labor and Workforce Development, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Career Advancement Center, to establish programs and deliver services to prepare dislocated workers for re-entry into the labor force and to offer training to those facing serious barriers to productive employment (LW09F133DWRSP13). RESOLUTION NO. RS2015-1460

A resolution approving Amendment One to a grant from the State of Tennessee, Department of Labor and Workforce Development, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Career Advancement Center, to establish programs and deliver services to prepare eligible participants for re-entry into the labor force (LW09F151ADULT15). RESOLUTION NO. RS2015-1461

A resolution authorizing French’s Shoes and Boots, LLC to construct and install an aerial encroachment at 126 1st Avenue North (Proposal No. 2015M-009EN-001). The resolution was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committees.

RESOLUTION NO. RS2015-1462

A resolution authorizing the Metropolitan Department of Law to compromise and settle the Metropolitan Government of Nashville and Davidson County’s subrogation claim for in-line-of-duty injury benefits paid on behalf of employee Thomas Goad in the amount of $13,333.33. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2015-1420

A resolution appropriating to certain accounts for the benefit of the Board of Fair Commissioners, Nashville Farmers’ Market, and Municipal Auditorium, One Million Eight Hundred and Forty Nine Thousand Six Hundred Dollars ($1,849,600). Mr. Pridemore offered a substitute resolution and moved that it be accepted for filing and which motion was seconded and adopted by a voice vote of the Council.

SUBSTITUTE RESOLUTION NO. RS2015-1420

A resolution appropriating One Million One Hundred Forty-Eight Thousand Nine Hundred Dollars ($1,148,900) to certain accounts for the benefit of the Nashville Farmers’ Market and Municipal Auditorium. The resolution was approved by the Budget and Finance Committee. A resolution supporting the efforts of the remaining residents of the James Robertson Towers to find safe and affordable replacement housing, and requesting the new owners of the building to take the necessary action to secure permanent housing and cover the relocation expenses for the remaining tenants. An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 500 linear feet of an eight inch sanitary sewer line and easement, abandon approximately 375 linear feet of a six inch water main and easement, and to construct approximately 609 linear feet of eight inch sanitary sewer main for property located at Main Street (unnumbered) (MWS Project No. 14-SL-46 and 14-WL-44, and Proposal No. 2015-011ES-001). BILL NO. BL2015-1112

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 146 linear feet of an existing 10 foot public water main easement for property located at 2971 Kraft Drive (Proposal No. 2015M-015ES-001).

BILL NO. BL2015-1113

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to replace approximately 2,520 feet of six inch C.I.P. public water main with 12 inch D.I.P. and to accept approximately 1,150 linear feet of 12 inch D.I.P. public water main and easement for property located at 719 Thompson Lane (MWS Project No. 15-WG-0131 and Proposal No. 2015M-016ES-001). The bill was approved by the Planning Commission. BILL NO. BL2015-1066

An ordinance amending Chapter 7.08 of the Metropolitan Code pertaining to prohibited acts by beer permit holders, agents, and employees. The Public Safety-Beer and Regulated Beverages Committee recommended indefinite deferment. Mr. Scott Davis moved to defer the bill indefinitely, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2015-1067

An ordinance approving an agreement relating to the sale and redevelopment of the property on which the old convention center is located (Proposal Number 2015M-009PR-001). An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to negotiate and accept permanent and temporary easements for the Ben Allen Road Stormwater Improvement Project for 17 properties located along Hart Lane, Hutson Avenue, and Ben Allen Road (Project No. 14-SWC-122 and Proposal No. 2015M-013ES-001). BILL NO. BL2015-1075

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 160 linear feet of an eight inch sanitary sewer main and easement and to construct approximately 231 linear feet of an eight inch PVC sewer main for properties located at 520 26th Avenue North and 26th Avenue North (unnumbered) (MWS Project No. 15-SL-2 and Proposal No. 2015M-010ES-001). BILL NO. BL2014-897

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R10 to RS10 zoning for various properties located along Auburn Lane, Dartmouth Avenue, Tulane Court and Woodmont Lane, south of Woodmont Boulevard (approximately 23.87 acres), all of which is described herein (Proposal No. 2014Z-054PR-001).
