ORDINANCE NO. BL2015-1107

An ordinance to amend the Geographic Information Systems Street and Alley Centerline Layer for the Metropolitan Government of Nashville and Davidson County by abandoning a portion of Molloy Street right-of-way and easement, and authorizing the execution of a quitclaim deed to convey any interest the Metropolitan Government possesses in the right-of-way of Molloy Street that would not already be extinguished by the aforementioned abandonment. (Proposal Number 2015M-008AB-001).

WHEREAS, it is the desire of all the abutting property owners that said abandonment be accomplished as shown on the sketch attached as Exhibit A; and,

WHEREAS, the closure has been requested by Gresham, Smith and Partners; and,

WHEREAS, there is no future need for said Molloy Street right-of-way for Metropolitan Government of Nashville and Davidson County purposes.

WHEREAS, in order to clarify the fee ownership of the property currently burdened by the right-of-way, Grantee has further requested that the Metropolitan Government quitclaim such interest as it may possess in such property to Grantee pursuant to the deed attached as Exhibit B.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Geographic Information Systems (GIS) Street and Alley Centerline Layer for The Metropolitan Government of Nashville and Davidson County, as enacted by Ordinance No. BL2015-1041, is hereby amended, as follows:

Molloy Street at the northeast corner of 2nd Ave South and Molloy Street in front of Map 09306409600, all of which is more particularly described by lines, words and figures on the sketch which is attached to and made a part of this ordinance as though copied herein, is hereby abandoned.

Section 2. That said right-of-way, including all utility easements within it, are herein abandoned.

Section 3. That the Director of the Department of Public Works be and hereby is authorized and directed, upon the enactment and approval of this ordinance, to cause said change to be made on said GIS Centerline Record as set out in Section 1 of this ordinance, and to make notation thereon of reference to the date of passage and approval of this amendatory ordinance.

Section 4. That the Director of Public Property Administration or his designee is authorized to execute the quitclaim deed attached hereto as Exhibit B conveying such interest as the Metropolitan Government may have in the Property to Lester L. Turner, Jr. and C.T. Thornton, Co-Trustees.

Section 5. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
