ORDINANCE NO. BL2015-1060

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon 125 linear feet of existing 48 inch combination sewer main and easement, and to accept approximately 215 linear feet of 48 inch combination sewer main and easement for properties located at 210 and 310 First Avenue South, (MWS Project No. 14-SWC-0018 and Proposal No. 2015M-006ES-001).

WHEREAS, the abandonment of 125 linear feet of existing 48 inch combination sewer main and easement, and the acceptance of approximately 215 linear feet of 48 inch combination sewer main and easement for properties located at 210 and 310 First Avenue South are needed to construct project number 14-SWC-0018; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2015M-006ES-001 on January 29, 2015 for the abandonment and acceptance of said sewer mains and easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon 125 linear feet of existing 48 inch combination sewer main and easement, and to accept approximately 215 linear feet of 48 inch combination sewer main and easement for properties located at 210 and 310 First Avenue South, as shown below and on Exhibit 1, which is attached hereto and incorporated by reference:

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
