RESOLUTION NO. RS2015-1462
A resolution authorizing the Metropolitan Department of Law to compromise and settle the Metropolitan Government of Nashville and Davidson County’s subrogation claim for in-line-of-duty injury benefits paid on behalf of employee Thomas Goad in the amount of $13,333.33.
WHEREAS, on July 19, 2011, Nashville Fire Department inspector, Thomas Goad, was inspecting sprinkler heads that had recently been installed as part of a renovation project. While inspecting the building’s mechanical room, Mr. Goad inadvertently stepped into an open A/C duct pit in the floor, causing him to fall. He sustained injuries as a result of the fall and the Metropolitan Government paid both his medical bills and lost wages under its in-line-of-duty injury program.
WHEREAS, after investigation, the Metropolitan Department of Law believes that the settlement listed in Section 1 is fair and reasonable and in the best interest of the Metropolitan Government; the Department of Law recommends that the Metropolitan Government accept $13,333.33 in satisfaction of its claim.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1: The Metropolitan Department of Law is authorized to compromise and settle the Metropolitan Government’s claim for damages for the sum of $13,333.33.
Section 2: This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
